‘Unfair’ tender process: case against KZN transport department postponed

A CASE in which the SA Federation of Civil Engineering Contractors (Safcec) accuses the KZN Transport Department of awarding all its road maintenance and construction contracts to an “exclusive club” in KZN has been postponed until next year.

Safcec alleges that KZN contracts are only being awarded to tenderers who fall under the “Vukuzakhe programme”, which was introduced to address past economic inequalities resulting from apartheid, to the detriment of all other contractors.

The case was yesterday postponed to May 10 next year by Judge Anton van Zyl in order to give an opportunity to the national minister of Finance to be joined as an interested party in the case due to a constitutional point being raised by province.

This is to the effect that the Procurement Policy Framework Act does not go far enough in addressing the economic imbalances of the past.
