Witness given leave to apply in bid to halt lawyers’ gagging attempt

THE WITNESS was yesterday given leave to apply to intervene in proceedings brought by advocate Penny Hunt against a magistrate and police relating to the validity of the seizure of documents from her chambers on March 14.

The Witness’ s application to intervene is aimed at opposing an order sought by Hunt to prevent publication of her application and the contents of her papers in support of it.

The Witness was directed to file its application by May 10.

Hunt also sought an order that the police furnish her attorneys with a record of all their affidavits, documents and correspondence upon which the application for a search warrant of her chambers was granted.

She also asked for an order that the police be prohibited from accessing or inspecting the records obtained from her chambers.

Judge Piet Koen said he was not at this stage disposed to grant an order prohibiting publication of Hunt’s application or the contents in support of it.

Advocate Jaap Cilliers SC, for Hunt, said that an order for the delivery of the documents was no longer necessary as they had been furnished by the police.

An order was granted by consent preventing the police from accessing the documents pending finalisation of the application.
