uMngeni’s ‘just rates’ campaigner Rolf Warber dies

Rolf Warber, a driving force behind the Just Rates group in the uMngeni Municipality, died on Tuesday.

Warber had been in dispute with the municipality over the payment of rates and had not paid rates since the 2004/2005 financial year on the grounds that the municipality has not levied rates according to the appropriate legislation.

In May this year it was agreed at the Pietermaritzburg High Court to put aside the dispute over the legality of how rates are collected.

The municipality had approached the court for an order seeking to prohibit Warber from instituting further legal proceedings unless a court ruled that the proceedings are “not an abuse of the process of the court”.

In an affidavit before the court, uMngeni municipal manager Dumisani Vilakazi said Warber had instituted at least six cases in various equality courts against the municipality, all stemming from his allegations that the municipality is levying rates using the incorrect legislation.

Warber also laid two criminal charges of fraud against the municipality, and wrote numerous letters to the municipality and to the press alleging that uMngeni is levying rates illegally.

After the hearing, Warber and advocate Rob Seggie, for uMngeni, agreed that the case be adjourned indefinitely.

Warber told the court he would reconsider his options about three other cases he had brought against the municipality in Howick.
