Dear Advocate AbrahamsA REQUEST FOR CLARITY AND MORAL COURAGE ON STATE CAPTUREWe, as with millions of South Africans at home and abroad, are concerned by the increasing evidence of state capture focusing largely on the Gupta family and President Jacob Zuma.This letter is a request for clarity on your plans to conduct a thorough and appropriate investigation into and prosecution of the notorious Gupta family, President Zuma and others against whom strong evidence exists of state capture and undue interference in government, along with money laundering and other corrupt activities. The victims here are South African citizens and taxpayers.You are no doubt fully aware of the vision and powers of the Constitution of South Africa, particularly section 179, and the National Prosecuting Authority (NPA) Act, which empower you to institute and conduct criminal proceedings on behalf of the state and make it your responsibility to ensure justice for the victims of crime by prosecuting without fear, favour or prejudice.You are also aware that the NPA plays a critical role in ensuring that perpetrators of crime are charged and held responsible for their criminal actions. The strategy of the NPA aims to ensure that it acts proactively to contribute to the growth of the economy and social development, contribute to freedom from crime, promote a culture of civic morality and ensure public confidence in the criminal justice system.In our view, the serious nature of the state capture allegations against the Gupta family, President Zuma and others within our government departments and state-owned entities, requires that as the head of the NPA, you should ensure proper investigations and full prosecution of these matters are undertaken. The sheer size and nature of this matter places the attention of this case squarely at your feet.There is more than sufficient evidence that the Gupta family, the state president and many within their extensive network of allies should be prosecuted, and if you require assistance and input which points to such evidence, we, along with many others in civil society and the free media will gladly be of help. We have no doubt that should you undertake this action, it will be a significant case and in turn, you will become the hero of the people. You will no doubt receive our support and that of many other civil society organisations, for as long as your actions are authentic, meaningful and reasonably swift and sincere.We would be fools to dismiss the dilemma you face in trying to deal with this issue. One can only imagine the trepidation and images of being left to stand-alone and face the wrath and backlash from your bosses, should you venture down this ‘forbidden’ path. Our assurance Advocate Abrahams, is that your sincere approach to tackling this matter will provide you with the biggest support a nation could bestow on you – the will and cheer of millions of ordinary, peaceful and passionate South Africans. In facing your quandary, it is important to note first and foremost that power which is compromised, is power not worth having. Today, you have an incredible opportunity to set the record straight; one that will set aside the criticism and display your true moral courage. You will need to be decisive and sure in your approach.This request also seeks confirmation that you are indeed investigating the state capture allegations against the Gupta family, President Zuma and others compromised in the many pieces of information on the matter of state capture and the corrupt conduct and use of state resources. And if so, how far are you with your investigation? And if by some chance you are not investigating this matter, please could you inform us as to the reasons why not?You live and preside over the NPA during a very interesting period; one that has graced you with an opportunity to be judged on how you decided to deal with the state capture cases.
