Competition terms and conditions

1. This Promotional Competition is organised by MTV BASE & KLIPDRIFT PREMIUM (collectively “Promoters”).

2. The promotional competition is open to entrants based in Cape Town who are over the age of 18 years in possession of a valid South African Identity Document except any employee, director, member, partner, agent or consultant or any person directly or indirectly who controls or is controlled by the Promoters and/or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control or controlled by the Promoters, their advertising agencies, advisers, dealers, suppliers and Bottlers of beverages identified by the trademarks owned by or licensed to the promoters, its affiliates and/or associated companies (“Disqualified Persons”).

3. By entering the promotional competition, all participants and winners agree to be bound by these rules which will be interpreted by the Promoters, whose decision regarding any dispute will be final and binding. The Promoters reserve the right to amend, modify, change, postpone, suspend or cancel this Competition and any prizes (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which the Promoters reasonably deem necessary.

4. The promotional competition commences on 21 February 2013 and ends on 27 February 2013 both days inclusive.

5. The prize (“the Prizes”) is ten (10) double tickets to the one single day of the MTV BASE & KLIPDRIFT PREMIUM URBAN SMOOTH SESSIONS. One winner receives a double tickets and this is for ten winners.

6. Competition winners must be able to get to Cape Town during the time of the event and be able to make their own way to the venue which is the St Yves. The Prize does not include transportation to the event.

7. To stand a chance of winning, participants must send an sms to the Drum Magazine’s sms line with the following details; First Name, Surname, ID Number, and city in which they live. The number for the sms line will be provided on Drum Magazine’s social media platforms, i.e. Facebook – DRUM Magazine and Twitter – @DRUMMagazine. Sms charge of R1.50 will be deducted from your account and free text messages do not apply.

8. Participants whose entries have been drawn will be notified via Drum Magazine’s social media platforms and telephonically on the prior March 1. The winner will be selected via a random draw conducted by Drum Magazine and winners to be announced via Drum’s social media platforms with follow-up calls to the winners’ mobile numbers. The Prizes will be available for collection from the promoters at the venue, on the evening of the event.

9. Entries which are unclear, illegible or contain errors or from Disqualified Persons will be declared invalid.

10. If the Promoters are unable to reach any person after drawing his/her entry for whatsoever reason, such person will be disqualified and the draw of a replacement entry shall take place in the same manner as the first draw.

11. The Prizes are neither transferable nor redeemable for cash and the Promoters are not liable for any defect in the Prizes. The Promoters reserve the right to substitute Prizes with any other prize of comparable commercial value.

12. Should any dispute arise in relation to the interpretation of these competition rules, the Promoters’ decision shall be final and no correspondence shall be entered into.

13. All participants and the winners, as the case may be, indemnify the Promoters, their advertising agencies, advisers, nominated agents, suppliers and Bottlers of beverages identified by the trademarks owned by or licensed to the promoters, its affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this promotional competition (including, as a result of any act or omission, whether as a result of gross negligence, misrepresentation, misconduct or otherwise on the part of the Promoters and/or use of the Prizes).

14. The Promoters will require the winners to complete and submit an information disclosure agreement and indemnification to enable the Promoters to ensure compliance with these rules and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this rule for any reason, such winner will be deemed to have rejected the Prizes and it shall revert back to the Promoters.

15. The Promoters may require the winners and/or their partners be identified, photographed and published in printed media, or to appear on radio and television, when accepting their Prizes and/or after having received their Prizes. The winners and/or their partners will be given the opportunity to decline to the publication of their images and to participate in the Promoters’ marketing material in so far as it relates to the Promotional Competition.

17. The judges’ decision is final

18. You may enter as many times as you wish.

19. Entries sent by registered post will not be collected.

20. Winners will be notified via social media/email/SMS/phone call by The Promoters within a day of the competition draw

21. Participants and winners of all competitions indemnify and hold promoters and clients unaccountable for any liability, claim, damage or loss that may result from participating or winning prizes.
