Day care mother acquitted of assault

A Pretoria day care centre owner has been acquitted of assaulting two children in her care in 2011, it was reported on Tuesday.

The Pretoria Magistrate's Court found that, in the absence of witnesses, there was insufficient evidence to link Linda Mans, 37, of the Teddy Winks day care centre in Mountain View, to the assaults, Beeld reported.

"The mere fact that the child was in her care does not mean that any reasonable court can find her guilty of assault with the intent to cause serious harm," Magistrate Adriaan Bekker was quoted as saying.

Mans, who pleaded not guilty to assaulting a baby girl and a baby boy a month later, reportedly told the court she had left the children in someone else's care while she took her mother to hospital.

According to Beeld, the mother of one of the children testified that the child had bruises on its buttocks, lower back, arm and thighs after being "disciplined" at the day care centre.

The parents of both children told the newspaper they would consider a civil claim against Mans.
