Cops’ court case postponed

Warrants of arrest were issued for three police officers and a witness after they we “no shows” at Strand Magistrate’s Court on Monday.

The three policemen, constables Masithembe Jack and Siyabulela Ncinane and police reservist Phumlani Lamani, were not in court when the proceedings began.

They face charges of theft, assault and kidnapping, to which they have pleaded not guilty.

Emmanuel Odo, the witness, was also issued with a warrant of arrest for being absent from court.

Magistrate Francelien Mouton asked the three accused’s legal representatives if there were any instructions issued in respect of their absence. “Not at all, my lord” was an answer from one the accused’s lawyer.

In a previous appearance of the three accused, who were stationed at Langa Police Station at the time of the incident, Oddo related how they had raided the house he rented in Ralarala Street in Lwandle.

He alleged the police took R37 000, which he had in the house during the raid.

“It must be put on record that at 09:15 the accused and the witness were not in court. A warrant of arrest for the four is issued,” the magistrate said.

The investigating officer in the case was also absent from court.

The three accused, who are out on R2 000 bail each, made a brief appearance in court on Tuesday 24 July.

The case was postponed to December, as the legal representative of one of the accused one was booked off sick.

For Oddo, this is the second warrant of arrest issued for failing to appear on time following an adjournment.

In the previous instance, Mouton warned him to be in court early.

Oddo had testified that the officers had entered his home and demanded to search it for drugs and a firearm.

The court also viewed cellphone video footage showing several police officers manhandling and forcing Oddo into the back of a van.

They were assisted by an unknown man wearing a camouflage jacket.
