Inquiry into state seizure welcomed

The African People’s Convention (APC) welcomes the appointment of the Judicial Commission of Inquiry into State Capture announced by President Jacob Zuma.

This shows he has heeded to the injunctions of the Public Protecor but has also responded to society’s demands of rooting corruption.

The APC endorses the broadening of the Inquiry, so that it serves as a legitimate instrument, to shed light on the workings and extent of the state capture, and is not used to settle personal or political scores.

The APC also welcomes the endorsement by the Office of the Public Protecor in its support for the broad sweep that the Inquiry will cover. We agree with President Zuma‘s statement that “there should be no area of corruption or culprit that should be spared the extent of this Commission of Inquiry “.

The APC views any attempts to deviate or undermine both the spirit of the extended terms of reference as expressed by President Zuma and the Office of the Public Protecor as self-serving, expedient and not in the interest of rooting out corruption.

The APC does not object to President Zuma’s decision to appeal the judgement of the High Court.

Whereas others have sought to gain mileage by claiming that this was a delaying tactic by the President, we hold a different view.

The Constitution is clear with regard to the powers of the President. It is our considered view that the ruling by the High Court offends the letter and the spirit of the Constitution.

In addition it borders on undermining the Constitutional principle of seperatition of powers.

Lastly, it is the contention of the APC that a capitalist state is a captured state.

In this regard the Terms of Reference of the Inquiry must investigate the full extent of how individuals and cabals have influenced state apparatus outside the law for their benefits or to the detriment of the people.

The APC asserts that any act of state capture by an individual or faction of class interests is bad, and must be exposed, and fought relentlessly. A narrow approach is sectarian, and looks like a tussle amongst the elite for a prime spot at the trough.

Let justice prevail. The process must be underpinned by the precepts of fairness and conducted without fear and prejudice. APC stands committed to the principle and practice that national interest must always trump over personal ambitionand political expediency.
