Rapist gets 10-year jail sentence

JUSTICE was served when a 47-year-old man was sentenced to 10 years’ imprisonment in the Kokstad Regional­ Court last week for the rape of an 18-year-old girl.

The man is originally from Matatiele, but has been living overseas with his wife. According to reports the man, who cannot be identified as his identity will reveal the identity of the victim, had come alone to visit his family in Matatiele in 2011 when the rape occurred.

NPA KZN regional spokesperson Natasha Kara said the rape occurred in 2011 when the accused asked the girl, who is known to him, to accompany him to a nearby house to fetch some items.

“While driving to the place, the accused stopped in a dark spot and asked her to have sex with him. When she refused, he locked the car doors, put on a condom and forcefully had sexual intercourse with her. He threatened to harm her if she reported the incident,” she said.

The victim wrote an exam at school the next day and then reported the rape to her friend, asking her to keep it a secret. The friend refused and told her mother who alerted the police.

The accused pleaded not guilty saying that the intercourse was consensual and was initiated by the victim. During cross-examination, regional court prosecutor Ntandazo Jaca asked the accused if he had a girlfriend in South Africa and the accused said that he did not.

Jaca then asked him why he had a condom in his possession when (according to him) the girl had initiated intercourse. The accused could not explain why he had the condoms if he did not intend on having sexual intercourse.

Jaca argued that the accused had planned the offence. He said it was highly improbable that the victim would have initiated sexual intercourse with the accused since she respected him as a father figure.

“The National Prosecuting Authority welcomes the sentence handed down to the man as it will deter other would-be offenders,” Kara said.
