Will drawn up free of charge

Members of the public who do not have a will are encouraged to take advantage of the opportunity offered during National Wills Week, from Monday, 17 September to Friday, 21 September, to have a basic will drafted by an attorney free of charge.

The Law Society of South Africa has stated that attorneys’ firms throughout the country participate in the National Wills Week project.

A valid will allows someone to state their last wishes, as well as who should inherit their assets and property. It also enables someone to appoint an executor of choice for their estate and a guardian for minor children.

Documents needed are an ID document and a list of what the person drawing up the will owns (including specific personal items that they wish to bequeath to specific people).

Before going to the attorney, the person should think about who must get what, who should be the legal guardians of their minor children (those younger than 18) and who should be the executor of their will.

If they decide on a family member or friend, it is advisable also to nominate the attorney as co-executor, as the attorney will deal with any legal issues.

Someone who married, divorced or was widowed recently, or who has started cohabitating with their partner or have bought new property, must have a will.

Similarly, unmarried persons – particularly those who may have a number of people and extended family members who depend on them financially – should ensure they have a will in place, as several people could make a claim on their estate.
