40 years for possession of illegal firearm and ammunition

GREYTOWN Regional Magistrate, Mr Ngema, last week handed down a 40-year sentence to 41-year-old Sihle Gasela for being in possession of an unlicenced semi-automatic pistol and ammunition.

On 27 February, 2014, Greytown police, acting on information received, approached the accused near the Greytown taxi rank, conducted a body search and recovered a firearm and seven rounds of live ammunition.

Gasela pleaded not guilty to the charges. He said the police had simply accosted and assaulted him for no reason and then took him to the police station where he was falsely implicated in this matter.

The state however, led evidence which proved beyond a reasonable doubt that the accused was in fact found to be in possession of the firearm and ammunition.

Regional Court Prosecutor, Mrs Premie Naidoo argued before the court that she had prosecuted the accused for being in possession of a prohibited firearm in terms of the Firearms Controls Act 60/2000 as the firearmand#039;s serial number had been erased.

This she argued, empowered the court in terms of the Firearms Controls Act to sentence the accused­ for to up to 25 years’ imprisonment for the possession of a prohibited firearm and 15 years’ imprisonment for possession of the ammunition - the accused had previous convictions for robbery and possession of unlicenced firearms.

The court sentenced him to 40 years and ordered that the sentences run concurrently
