Rapist sentenced to life, released on bail

A 41-YEAR-OLD man, found guilty of rape and sentenced to life, has been released on a bail of R5 000 pending leave to appeal.

The victim of the rape is physically and mentally challenged.

On 22 June, Lawrece Ngenisa Ngcobo forced his way into the woman’s home.

After checking that nobody was at home he forced the woman into a rondavel and raped her.

Because of her handicap she was unable to defend herself or shout for help.
When her mother returned home later, she found the victim, almost naked and unable to move, but was able to identify the rapist to her mother.

Nbcobo apparently was aware that the victim was mentally challenged.
At the time he was employed at the waterworks close to the victim’s home which he walked past almost daily.

Ngcobo was arrested and charged with rape.
He denied the allegations against him, however regional prosecutor Premi Naidoo, for the state, presented a case, which proved beyond reasonable doubt that it was in fact Ngcobo who had committed the rape.

In the Kranskop Regional Court on 17 November acting regional court magistrate, Mr S. Collins, sentenced Ngcobo to life imprisonment and then released him on R5 000 bail.

In terms of the law, the appeal has to be heard within 14 days by a High Court judge.

The community in the remote rural area of Gcotoi have expressed their concern and dismay that the rapist was not behind bars and allowed to ap-peal, particularly in the light of the brutal attack and the vulnerability of the victim.
