Town planning scheme to be included in tender conditions?

THE Msunduzi Municipality’s Executive Committee (Exco) noted a comment to investigate whether it can include the town planning scheme rules as part of tender preconditions.

Councillor Judith Lawrence said the municipality should not award tenders to businesses which operate in areas not zoned for business.

“Do we make sure that these businesses are operating from legal business premises in terms of our town planning scheme because I have picked up one which is operating a business from a special residential area.

“I am not aware of them having had permission to do so. If we are going to be enforcing our town planning scheme we must make sure that the people who we award contracts to also operate legally in terms of our town planning scheme.”

The Msunduzi municipal manager Mxolisi Nkosi said that tender preconditions are that businesses should not have relatives working within the system and that if they have municipal services accounts like rates, water and electricity, those accounts must be paid up to date.

“We have not included the compliance with town planning issues,” said Nkosi.

He said that for this to be part of the tender conditions, it should be applied to everyone tendering with the municipality.

Msunduzi mayor Chris Ndlela said that by adopting town planning scheme as part of the tender conditions, the municipality may be open to libel.

“It can only affect people who live in the city. What about those who live in Mgeni?” Ndlela asked.

Lawrence said that businesses would then need to produce a document from their local authority to say they are operating at areas zoned for business.

Exco noted Lawrence’s comment and Nkosi said that they will investigate if this can be feasible
