Accused’s bid for bail

COMMUNITY members might take the law into their own hands should the alleged killers of a woman and her child be released on bail.

Only one of the alleged killers, Ayanda Makhehla Mkhize, applied for bail in the Pietermaritzburg Magistrate’s Court on Tuesday.

His co-accused, Philani Ndlovu, has abandoned his bail application for now.

Both men are charged with the murders of Kwenzekile Maphumulo (29) and her two-year-old daughter, Melo­kuhle, on May 26 in the Bishopstowe area. They are also charged with the attempted murders of Nomfundo Goge Maphumulo (33), Velile Maphumulo (19) and Alfred Maphumulo (71).

State prosecutor Rene Padayachee read out the investigating officer’s affidavit in opposition to bail in which he outlined the evidence.

Sergeant N.H. Mkhize said it is alleged that at about 4.30 pm that day an argument broke out between Ayanda Mkhize (not the accused Ayanda Makhehla Mkhize) and Ndlovu at Ndlovu’s homestead.

Ndlovu allegedly hit Ayanda Mkhize on the head with a whisky bottle, then went home.

While there, he was contacted by Ndlovu’s brother and told to return to the homestead to resolve the matter. Ayanda Mkhize took a friend, Bhuzuzu Maphumulo, along with him.

However, the issues remained unresolved and another fight broke out, said the investigating officer.

Shots were fired and Ayanda Mkhize was injured.

He and Maphumulo went to the hospital for Mkhize to be treated.

While they were there, Maphumulo received a call informing him that his family members had been attacked. Two were killed and three injured. The officer said that the accused, Ayanda Makhehla Mkhize, was seen by witnesses at the murder scene. He was also seen in the Ematimatolo area where the firearm suspected to be used in the offences was found.

He said there is a strong case against Ayanda Makhehla Mkhize. The officer said he is afraid that the witnesses, who are known by the accused, will not be safe should he be released on bail. Also, the men do not have any assets and one suspect is still at large.

He said the attack was well planned and the accused were armed with firearms. They killed innocent people who were not involved when the arguments took place. The bail application continued on Wednesday. The outcome was unknown at the time of going to press.
