Alleged rape victim to be ‘kept updated’

AT the bail hearings of the two teenagers, aged 16 and 19, accused of allegedly raping a 25-year-old woman in Cinderella Park on August 19, the public were excused from the gallery because one is a minor.

The victim’s supporters, who attended the hearings, complained about the motion to close the courtroom to the public and the alleged victim.

The first bail hearing was on Tuesday, August 29, which was postponed to Friday, September 1, with the last on Tuesday, September 12, where the two accused were granted R1000 bail each.

They are to appear in court again on September 28.

Those who had expressed their concerns said the alleged victim’s exclusion is not fair since she remains unaware of proceedings and the reasons for the decisions taken by the court.

Regarding the exclusion of the alleged victim from the hearings, KZN National Prosecuting Authority Director of Public Prosecutions, Advocate Moipone Noko said: “Bail proceeding were held in camera [behind closed doors] as is required by law when a minor litigant is involved, in this case, the accused.

“The complainant would have been allowed to be part of the proceedings, depending on the stage thereof. However, in this case, it was not known that the complainant is among those who left the courtroom. The investigating officer must keep the complainant updated on the progress of the case.”
