Court order a win for local high school

A PROVISIONAL order preventing the Education Department from transferring a teacher to Russell High School was yesterday confirmed by the high court.

The school’s governing body claimed that the department had not followed proper procedures in authorising the transfer, saying the post was never advertised. The governing body also took issue with not having been consulted about the transfer or appointment of the new teacher. One of the concerns was that the school stood to suffer “irreparable harm” because a teacher who may not be suitable to its needs may be forced on it and the pupils.

The department, however, said it made financial sense to transfer this teacher to the school because her position at the school she was at was found to be surplus. It also submitted that the transfer was done lawfully.
