THE family of Khulekani Khanyile (43) from Elandskop, who was shot and killed, allegedly by a neighbour, wants justice. Khanyile was shot at his tavern in the early hours of December 24 last year.

Khanyile’s family say that since the death of their son they haven’t found peace.

Msawenkosi Khanyile (brother of the deceased) told Echo that as a family they want answers from the police on what happened to the case as the alleged killer is “walking free”.

“The problem started when my brother ordered eggs from our neighbour and he [neighbour] failed to deliver. My brother had a tavern next to our home where he was relaxing with his friends on the day of the incident.

“The neighbour came to my brother’s tavern on December 23 and said he wanted to buy something. My brother asked him to leave and told him that he must first bring the eggs. He [neighbour] then left and came back at around 1 am with a gun and shot my brother,” he said.

Upon hearing the news, Msawenkosi says he and his family went to the tavern where he claims they found the neighbour at the scene, still carrying the gun that he allegedly used to kill Khanyile.

“When he [neighbour] saw my mother, he ran away and handed himself over at the Taylors Halt Police Station but the next day he was released.

“I went to the police station to question why he is free while my brother is dead. They told me that he was going to appear in court on December 27 but that never happened. I went to court to ask if he had appeared but they told me that the docket was not enroled due to a lack of evidence,” he said.

The Khanyile family feels that the police have failed them. Msawenkosi said they demand answers on what happened to the case.

“How can they say that there is no evidence and witnesses while my brother was shot in front of his friends? The friends even came to us and told us that they are willing to testify.

“We told the police but still they are saying there are no witnesses.

“My brother’s killer walks the streets and boasts that if you have money you can do anything and get away with it.

“This hurts us as a family because we want to see this man pay for his actions. We want justice as maybe it will help us get closure enable us to move on.”

Pietermaritzburg police spokesperson Mthokozisi Ngobese said the accused was arrested and he appeared in court. “The charges were subsequently withdrawn for further investigations.It will be taken back to court in due course.”
