Endangering children’s lives is against Constitution

ACCORDING to Act 23 of 2007 Section 2(1) (a) of the South African Tobacco Legislation: “No person may smoke in any vehicle or car when a child under the age of 12 years is present in that vehicle.”

The South African Constitution states in Section 28.1 f. that “not to be required or permitted to perform work or provide services that place at risk the child’s well-being, education, physical or mental health or spiritual, moral or social development.”

Section 28.2 states “the child’s best interests are of paramount importance in every matter concerning the child.”

One morning recently at the Oribi Plaza traffic light, a woman in a Bantam bakkie was puffing away with primary school children inside.

I felt my throat and my lungs clamping up on their behalf.

The right of the child to breathe fresh air is higher than the right of an adult to breathe smoke.

It is a human right like any other that has to be conformed to.

Children do not know this and they are also not in a position to do something about it even if they did.

They are embarrassed at school when they smell like ashtrays.

It is the responsibility of the public and the authorities to take on these selfish smokers who just do not care.
