Pensioners to receive title deeds to flats

A TOTAL of 41 titles deeds will be handed to the residents occupying the pensioner’s flats in Deepvale Road, Hibiscus Drive and Venus Drive, Marburg.

The Hibiscus Coast Municipality resolved this decision on Tuesday and has started the transfer verification process.

The time frame for this process cannot be established.

“The remaining 27 flats are being occupied illegally.

“There are no pensioners living in these flats and they have had no legal permission to occupy them,” said municipal manager Maxwell Mbili.

He said according to Constitution, the eviction process is not easy and the people living in the flats will have to be profiled.

“We have to determine if there are indigent families living in these flats. If there are, the flats will be transferred to them,” he said.

Mbili added that those who are not indigent, will be given first preference to purchase the flats they are occupying before it is put to anyone else to purchase.

This Sectional Titles Act 95 of 1986 prescribes that immediately after the transfer, the body corporate is created­ automatically with the developer (council) and the first owner, thereafter within 60 days of that transfer the developer (council), must call an annual general meeting to elect trustees of the body corporate.

In this process, a minimum of two trustees must be appointed.

In addition, Section 2(8)(a) of the Sectional Titles Schemes Management Bill also provides that a developer ­ must convene a meeting of the members of the body corporate not more than 60 days after the establishment of the body corporate.

“The municipality feels proud that pensioners will have ownership of the units and this process will improve their quality of life,” said Mayor Nomusa­ Mqwebu.
