ANC to withdraw Spear case

Johannesburg - The ANC will withdraw its case against the Goodman Gallery, the gallery’s director Liza Essers announced at a media briefing on Wednesday.

Essers was speaking at a briefing with ANC spokesperson Jackson Mthembu on details of an agreement reached between the parties after a march in protest against a painting depicting President Jacob Zuma with exposed genitals.

Mthembu and Goodman Gallery director Liza Essers addressed the group of journalists at the gallery, in Jan Smuts Avenue, Rosebank.

She said the gallery and The Spear artist Brett Murray did not intend to insult anyone in the painting which features President Jacob Zuma with his genitals exposed.

But she also said that “we can’t be in a situation where artworks are censored” and that it appeared the “ANC have heard that”.

“Art by its nature is controversial,” said Essers.

      Aaahhhg Polotrolloyonki - get a life. The whole of Africa is living in poverty because of lack of education, and in many cases ethnic inabilty to progress. (Not a racial slur!). Whilst I don't condone Apartheid in any form whatsoever, it's time to get off that horse, and take some responsibility for your own life. Simply put, what is passed is gone.       @Polo Read this...let me give you an education,: Much like inheriting a billion pounds only to die broke or forfeiting a three goal half time lead; ineptocracy is one’s failure to succeed from a position of strength. A political example of ineptocracy would be South Africa’s ruling party the ANC; who after 18 years of leading one of the most fertile and resource rich countries in the world hasn’t developed any sustainable solutions to generating wealth for its people beyond affirmative action, land redistribution and the nationalization of assets. After almost two decades of rule, the ANC’s sole solution to endowing its people is still to merely take wealth away from others. Surely this is their failure? Consider that South Africa is the only country in the world whose affirmative action policy favours a majority who also happens to have complete political control. In the rest of the world affirmative action is designed to favour the politically un-represented minority, not the politically strong majority. South Africa now appears to have a system of government whereby the ruling party is elected by the non- contributing majority, who in turn are then rewarded with subsidies, goods and services paid for from the earnings of the contributing minority.

      @Polo - partly true, but destructive behaviour and 'gimme gime' attitudes are not going to get Africa on her feet. Building on what is already there, is the only way forward. Re - the minerals etc. .. the ANC is courting disaster by siding with China who will soon be the World No1 Power. They give less of a damn for Human Rights than the Colonialists did, and our minerals are China's sole interest in Africa. When they step in, you will be wishing for Apartheid back! Then, take Shell, and the Karroo Fracking ... obviously corruption is rife, and the ANC is going ahead under the guise of "Creating jobs', while the environment and underground water gets contaminated permanently. Some day soon, water is going to be the World's No 1 crisis.... but for money, the ANC will turn a blind eye and make that somebody else's problem.       If we have learned anything from the Spear Saga it's that South African democracy is still a long way off from being able to be called a 'mature democracy'. I think the artist succeeded very well in getting people to debate and talk to each other about subjects that are not normally easily spoken about. There is positiveness and negativity in everything.

Judging by the comments that were made by some whites in this forum (Koos, piet, loo just to name a few), the DA, and other white people in general, one can tell that blacks will suffer even more than they did during apartheid should the whites minority take over power again. I was one of those who was going to vote for the DA in the coming elections but after this, I wouldn’t, nor will I vote for the ANC either. Rather go and cast a spoiled vote as a form of protest.

      My domestic worker said she was not going to vote in the last election because there was sewerage in the streets of tembisa. Not voting for a party after the struggle for democracy seems stupid in my opinion. Why would you not want to be heard?

      If it wasn't The Spear, then Zuma would have found something or someone else to point a finger at and cry 'racist white'. Let's face facts, it's not hard to find a racist, black or white, in this country. Brett has been drawing penises on everything he paints since early on in his career including Bart Simpson so I'm sure he didn't think too much about slapping one on ole Zuma. Poor guy's next painting will probably be a self portrait of himself with a goat between his legs and titled 'Scape Goat'. Might I suggest that you do like me in 2004, when neither the ANC or the DA impressed, and vote for a smaller party?

    I have learned that racism encompasses more than hating a person for the colour of his/her skin. There is still so much I don't know about other people living here. Perhaps we should be more sensitive about some of our European values practised in SA. Maybe we can teach each other?

    The ANC has no option but to withdraw the case. This case by the ANC, is against its own laws and government. It would be good for the nation and the constitution for the constitutional court to rule on this matter. This conflict between these rights will always be there. ANC is afraid of being embarrassed in court.

    Can the ANC please withdraw this Spear issue on ALL fronts, and focus on the real issues affecting ALL South Africans.I think this Spear issue has been an overkill that deflected a lot of the ruling party's shortcomings.

    Why? Could it be that they don't want to take a chance of seeing their counsel (Adcocate) weeping again in court? Surely he already knew that he was going to lose that one as well - like they always lose all their cases in court; hence the fact that they resort to intimidation, scare tactics and mob justice!     the ANC is wasting our time cause spear is issue doesnt even worth to be on news,i think all south africans are facing real challenges of the gauteng etolling system,high rise of unemployment,poor service delivery,health system that is on state of decay in our hospitals and education system in our schools which is failling our youth,the economy which is collapsing and corruption which reaping the country apart now that is something people could march for!

    As soon as Zuma and the ANC realised that he/they had to pay for the costs of the court case and not the South African taxpayer I knew they would quickly withdraw the case. Instead they will keep stirring the race card mob mentality against those pointing out the mockery to the dignity of the impoverished masses while their comrade leaders, who just happen to be black by the way in case no one has noticed, lord it over them. With top brother leader making a disgraceful mockery of moral and ethical leadership governance. I am sorry but even as I will be accused of being an arrogant whitey to comment on other cultures I refuse to believe this is the "African way"! This country and all its people deserve better.

    That amount is totally exorbitant, that budget could pay for the entire upgrade of the roads in Gauteng, clearly our government has got their priorities wrong if they can justify paying somebody not double not treble but almost 30 times more than our president! That's just for one year, that means in ten years we spend 590 million rand on one persons salary? How many new schools is that? How many doctors, teachers salaries. What about a new powerplant? I feel like storming the Bastille right now!

    Withdraw a case you were bound to lose anyway. My ruling party has taught me that if I want something done in this country, I must resort to bullying and death threats instead of legal avenues. That tells me that we are being governed by barbarians. This will come back to bite the ANC - they will live to regret circumventing the law.
