EFF members have protested outside the Gauteng police headquarters over the recent appointment of Bethuel Mondli Zuma as Gauteng police commissioner. WATCH

Johannesburg - The man who was about to become Gauteng's new provincial police commissioner, Lieutenant General Bethuel Mondli Zuma, is set to appear in the Pietermaritzburg Magistrate's Court on Tuesday, the NPA said.

"The trial is set to resume today and the magistrate will make a ruling regarding the way forward," National Prosecuting Authority spokesperson Natasha Ramkisson said.

National police commissioner General Riah Phiyega announced Zuma as Gauteng police commissioner on 31 August but withdrew the decision when it emerged he had a pending case against him.

Zuma was arrested in Pietermaritzburg in September 2008 for alleged drunk driving and not stopping at a roadblock.

He is also alleged to have prevented traffic officers from taking a blood sample to test for alcohol and locking himself in a house for two hours.

Phiyega said she was not aware of the criminal investigation against Zuma and came under fire over whether adequate background checks had been conducted on him.

He is not related to President Jacob Zuma.
