'Birthday rapist' free after slip-up

Cape Town - The man known as the "birthday rapist", accused of multiple counts of rape, was mistakenly released after serving a prison term on another charge, a report said on Friday.

According to Eyewitness News, the department said that Mlungisi Mtshali was mistakenly released from custody after serving three months in jail for a minor charge.

He then failed to appear in the Johannesburg Regional Court on Thursday, where he is facing rape, sexual assault and kidnapping charges.

National Prosecuting Authority spokesperson Mthunzi Mhaga said investigating officers are trying to trace and apprehend the suspect.

They did not know how such a mistake could occur, he said.

Mtshali's alleged modus operandi was to ask his alleged victims to join him in celebrating his birthday, and then take them to a hotel where he would allegedly rape them.

Thats what happens when you dont follow proper procedures in recruiting and end up with retards in crucial positions making crucial mistakes like this one. If this criminal commits new crime while out, his victims already have strong grounds to sue the state.

    there is no such thing as a mistake. who released him did that intentionally; and they might not find him ever again. it wasn't a mistake; a mistake is when i step on your toes unaware but here we are talking about justice how careless are they to do such a mistake?

      Whether he was "only" accused or convicted is irrelevant. The point is that he should not have been released, so it was another balls-up by a government department. Whichever deployed ANC cadre did this will no doubt soon be promoted.

    Serial rapist at first site seem like normal people and they blend into society well and that is why they keep repeating the same offences, I guess he must have blended in well with the petty criminals that serve minimal sentences and that deceaved the authorities and that's why he managed to ''defruad'' his way out of prison. In my view this was masterminded by mtshaliwithout anyone else knowing about it, these guys are like chameleons they blend in well and are not easily identifiable. But thanx to the good work of the police services as he is now apprehended and expected to appear in court soon.
