Booysen accused to apply for bail

Johannesburg - Two men arrested following the rape and murder of Bredasdorp teenager Anene Booysen are expected to apply for bail on Tuesday.

Jonathan Davids, 22, and Johannes Kana, 21, will appear in the Bredasdorp Magistrate's Court.

They are charged with raping and killing Booysen, 17. She was found on Saturday, 2 February, at the Asla construction site, where she worked, after visiting a club in the town the previous night.

She had been brutally injured and disembowelled. She died in hospital later that day.

At the pair's last court appearance on 12 February, Magistrate Graham Cupido ruled that their faces not be shown in the media because the State believed this could jeopardise the ongoing investigation.

In an interview Kana's uncle described him as religious and a talented sportsman.

Johannes Kana said his nephew, who has the same name and surname, had been to England to play cricket.

"I thought when he got back here that he would do his stuff like rugby and cricket, but look where he is now."

      Oscar was deemed to be neither a flight risk nor a danger to others; those are the criteria when considering bail. International Media is reporting that Reeva's skull was crushed, but the Prosecution left that out because they didn't want to reveal their case to Oscar's lawyers.       Ohbizz, I'm not particularly thinking of flight risk, but that "etc."! Women live in fear of rape; Anene indentified one of her rapists. I suggest he's dangerous - it takes a lot of rage to not only disembowel but to haul those intestines out of the abdominal cavity and dump them in the sand next to the victim. Bones were broken and Anene IDENTIFIED one of them; dying declarations carry a lot of weight. rm - Oscar is certainly not my golden boy, nor do I minimise what he did; he is, however, not a flight risk and while he was dangerous to Reeva, I put to you he's extremely unlikely to shoot ANYONE ever again. Re the international press - they as capable of reporting balderdash as much as we are. The court found criteria for bail had been met and that's good enough for me. If the court decides that Johathan Davids and Johannes Kana meet the criteria for bail, I'd be surprised, but that would be good enough for me, too.

      @ Tersia but bail depends mainly on whether you are a flight risk. Other stuff like being dangerous, meddling with investigation and witnesses etc are factors taken into account but which dont have as much weight as the main one. If it cant be shown you are likely to run away then you are likely to get bail. Remember that the idea behind bail is that only persons whose guilt has been proven and found in court should be in jail. Everybody else should have their "right" to be presumed innocent until proven otherwise #Not me, it is the law.

I personally think that Oscar killed Reeva in a fit of rage, but the reality is that we dont know... there is a possiblity that he killed her by mistake and I am happy to let the court decide that. So for oscar there are 2 possibilities 1) accidental killing or rage killing. But the Booysen's killers... named by her? What are their options of what happened? They took her away, gang raped her and then slit her open like an animal! Even if worst case Oscar killed Reeva in a rage ... u still think in terms of bail, the cases are the same?
