Boy, 13, in court for gang rape

Johannesburg - A 13-year-old boy, allegedly involved in the gang rape of a 17-year-old mentally impaired Soweto girl, will appear in Roodepoort Magistrate's Court on Thursday.

Four boys and three men, who matched the descriptions of rapists shown in a cellphone video of the attack, were arrested in Dobsonville, Soweto on April 17. The video went viral on the internet from April 18.

The four boys were granted bail by the Roodepoort Magistrate's Court on May 3. The three men allegedly involved in the rape remain in custody.

The case against the three men, one aged 18 and two 19, and the three 17-year-olds continues on June 20.

National Prosecuting Authority spokesperson Mthunzi Mhaga said at an earlier court appearance that the teenagers would not be diverted to a programme for young offenders.

"In respect of the fourth minor, the 13-year-old, we still have to determine his criminal capacity.

"Remember, between the ages of 7 and 14 they are presumed to be criminally incapable."

The boy's lawyer William Karam said a report on the boy's criminal capacity would take a month to compile.

"The youngster will be coming back on May 17, not for the report, simply to see where we [are] at," said Karam.

      A clear message should be sent to all would-be young thugs out there - You can't hide behind your age and it is NOT cool to rape. They seem to think that rape is not a crime.

    Put all these miscreants in one of our many abandoned mine shafts. At 2km below the surface there's little chance of escape and why should the victims be the only ones to suffer for the rest of their lives.
