Carl Pistorius acquitted

Johannesburg - Carl Pistorius - the brother of murder-accused paralympian Oscar Pistorius - is a free man.

He was acquitted on a charge of culpable homicide by the Vanderbijlpark Magistrate's Court on Tuesday.

National Prosecuting Authority spokesperson Medupe Simasiku said the State had failed to prove a watertight case against him.

"We do accept the decision of the court and we will not be taking any further action on this case moving forward," Simasiku said shortly after the judgment.

He was involved in an accident on 8 March 2008 which resulted in the death of Maria Barnard. Her motorbike collided with his bakkie.

Magistrate Buks du Plessis ruled that Pistorius was not a negligent driver, saying it was clear that Barnard was travelling at excessively high speed at the time of the accident.

    I am glad for this young man and still feel sorry for the family of the deceased. This is a decision by a court and was based on facts. When information about this accident came to light after Oscar's shooting incident many people turned against the Pistorius family as if they were all a bunch of criminals. I believe in Oscar's case justice will also prevail and will not be surprised if the sentence is much lighter than is generally expected by those who are biased against him and his family.

      People are biased against Oscar? No they're not. Very much the opposite from what I've heard. I think all people want to see is justice. What they expect to see is preferential treatment due to his status. Which brings us to your point - "will not be surprised if the sentence is much lighter than is generally expected" - I agree, he'll probably get away with murder.

      The truth never comes out in a court case. The prosecutor is normally an inexperienced junior person in the NPA. They then bring in a top lawyer with years of experience to manipulate the questioning of the witnesses in such a way as to create doubt. They would ask the same question over and over with slight differences until the witness trips up then they tel the magistrate that the witness is lying. It is only in the very high profile cases that the NPA actually gets experienced prosecutors to handle the cases. I have been through lots of court cases where I have seen this.

    The statement by the NPA spokesman is concerning. They are actually saying they are an incompetent bunch hence he walked free. So if they case had been handled by a competent prosecutor then he would be guilty? am sure the deceased family can use that and sue Pistorius for wrongful death.

      TinavoMagaisa, are you serious, not sure if you drive anything on the street, but all over they mention that she hit his vehicle at the back at a high speed - it means you the one in front cannot be blame for the accident. Did you ever see a motorbike at a high speed and coming from your back, there is no eyes at the back of your head all the time, so he could not see her in time. Carl stop and assist immediately which is normal, people compare him here with party animals going crazy on the roads. There is still a very silent case from March 2013 - a drunk no named lawyer drive into 12 people and kill a lot of them at night - he get bail everything,nobody worries about that, so what poor youngsters had a good time and was killed on their way home - they were walking in te street, but still no reason to be killed, seriously something to ask the NPA ....................

    If there ever was a steep learning curve for an outsider, the current situation of things in SA is a perfect example. Reading through this thread, the bile seems to have consumed all from both sides of the racial fence. Surely, people should make it harder for other people to wind them up.       And also consider that the charges should never have been brought in the first place - that there was little or no evidence supporting the state's case, but plenty contradicting it. That fault also lies with the NPA.

      Apparently she was doing 147km/h according to the defense team, not 200km/h. How many people have accelerated to 147km/h while overtaking another vehicle? I know it's illegal but it happens millions of times a day. The lesson bikers need to learn from this is to keep a safe following distance and watch out for careless drivers who swerve into their path without warning. I guess the same applies to all road users.

      Check your facts my dear. I am right. The case against Carl was re-opened before Oscar shot four bullets through a closed door and killed the love of his life. I'm not making this up. Carl was supposed to go to trial the same week as Oscar's bail hearing but the case was postponed. If you want to take me on, make sure you've done your homework.
