Cele wants Zuma to explain

Johannesburg - Former national police commissioner Bheki Cele wants President Jacob Zuma to tell the North Gauteng High Court in person the reasons for his dismissal, the Sunday Times reported.

In a replying affidavit filed this week, Cele criticised an affidavit submitted by Zuma's legal adviser Bonisiwe Makhene.

"Makhene has no personal knowledge of most of the matters to which she refers, more particularly the manner in which [Zuma] made the decision which is the subject matter of the review," Cele said.

Makhene said Zuma was guided by the findings of a board of inquiry when making the decision to fire Cele.

The inquiry, headed by Judge Jake Moloi, found Cele was not fit to hold office.

Makhene denied Cele's earlier claim that Zuma's decision was irrational and that the president had acted with an ulterior motive.

Cele said Makene's affidavit was inadmissable as it was hearsay and irrelevant. He would make an application for the affidavit to be struck out. It was Zuma's "constitutional duty to explain" to the court how he arrived at the decision to fire Cele.

"The decision-maker cannot rely on explanation by persons who do not state on the record that they participated in and advised the decision-maker on the process and reasons for arriving at the decision on the review," he said.

Cele is attempting to overturn his dismissal.

Moloi's inquiry was mandated by Zuma to establish whether Cele had acted corruptly, dishonestly, or with an undeclared conflict of interest in relation to two police lease deals he signed with businessman Roux Shabangu worth R1.7bn.

    Interesting! Haul JZ before a court (which he is terribly aversive to in the first place), put him under oath and cross-examine him. Or will we see another soap opera at taxpayers' expense to keep JZ away from it all? There is no honour amongst thieves and the pigeons are now coming home to roost. I cannot wait!

      @ Michael - He is aiming much higher! Cele logic: If Jacob was fired by Thabo, and Jacob is now president, then If Bheki was fired by Jacob, then it stands to reason that Bheki should become president!! Simple, really...

    Just like any other decision taken by our honorable head of state his excellence President Gedleyihlekisa Jacob Zuma yet again he is asked 2 go and explain himself in person that very much interesting and the former National Commissioner Mr Beki Cele is on the right trek indeed I always felt He was dismissed unfairly...we are indeed watching the space...this encounter indeed is getting interesting...

    Mr Cele we all do not know why you were relieved of duties but most people including our women and children feel very unsafe about shoot to kill instead of protecting them.that statement has caused deaths in the police force as well.we are for peace but you can apply for posts in the SAPS.ask a friend for a copy of city press.

    The best job in the world must be SA cabinet minister or director general. You don't need any particular skills and if/when you get caught with your hands in the cookie jar, you first deny everything, then you blame someone else or just blame apartheid for having made you do it. Then you will probably get "re-deployed" to some other position where you quietly go back to your old tricks. Or maybe you you'll be suspended with full pay and benefits for a couple of years. If things really stack up against you you'll just be dismissed and then after a year or two, you realign yourself with another well connected politician and come back to the political scene. Viva democracy SA style Viva!

    Well done, Cele, you have the moral high ground now. Get Zuma to be a man and say it to your face in public. It won't change your lack of competancy for the job BUT it will force Zuma to man up or admit defeat. Great when friends fall out in public.

    WAY TO GO MY GENERAL.According to the Labour Relations Act,an employer (in this case the SA GOVERNMENT LED BY ZUMA)must give support to the employee (in this case CELE) wherever/whenever perfomance is not upto expectations before REMEDIAL steps (which MUST BE a step by step process) can be taken.CELE WAS GOOD @DEALING WITH CRIME (which was his primary duty)BUT WAS FAILURE @ACCOUNTING(which is a secondary duty). What should have happened was an ARRANGEMENT like the GEORGE FIVAZ

    Cele had not benefited from the deal. He was just beaten with experience by the divisional commissioners in the head office. Why? Because he exposed the outsourcing of the forensic department which was done just before he assumed office. This done by some of the divisional commissioners who were due for retirement in few years. They had invested money the London based company that was going to take over forensics work. That was their way to secure pensions. So! Cele exposed the information to the parliament portfolio committee. They then managed to get him to sign the lease recommendations as he trusted their opinions, so he signed it over the car boot lid since he had to rush some where. That's whom they saw the opportunity to get back at him, since he was appointed by JZ. Zuma had to make the call to sack him because his credibility would have been questioned. I believe that this matter should have been referred to the Public protector to check whether Cele benefited, if not JZ should then given him a final warning and allow him to carry on as the General. He was good at his job and was loved by the SAPS members.
