Constitutional law expert supports wealth tax

Johannesburg - Constitutional law expert Pierre de Vos came out in support on Monday of Archbishop Emeritus Desmond Tutu's call for a once-off wealth tax imposed on those who benefited from apartheid.

"Not only is a wealth tax on white South Africans who earn a minimum amount of money constitutionally valid," De Vos wrote on his blog, Constitutionally Speaking. "It is also an important and welcome idea that must be supported by all right-thinking South Africans with even a smidgen of a conscience or common sense."

The tax would be a small gesture towards reconciliation and redress, he said.

"If I had been born black and poor, I almost certainly would not have gone to University and I would almost certainly never have been a Law Professor at UCT [University of Cape Town], earning quite a nice salary, thank you."

De Vos criticised the FW de Klerk Foundation for rejecting the idea of a reparations tax, and for saying in a media statement that it would be unconstitutional to do so.

"Such measures are not 'reverse discrimination' or 'positive discrimination' but are rather 'integral to the reach of our equality protection'."

ConCourt ruling

De Vos cited a ruling that was handed down by the Constitutional Court, titled Minister of Finance versus Mr Van Heerden in July 2004.

In this case, Van Heerden had complained that parliamentarians who first joined parliament in 1994 were getting better pension benefits over a five-year period than those who were parliamentarians in the apartheid era.

"Mr Van Heerden, an old apartheid era parliamentarian, complained that the scheme discriminated against whites because the vast majority of new parliamentarians in 1994 were black and those who served before 1994 were mostly white.

"The court rejected this argument, pointing out that Mr Van Heerden was still going to be far better off in terms of his pension than any parliamentarian who entered parliament in 1994 for the first time."

De Vos argued that this judgment supported Tutu's idea of a once-off reparation tax, which the Archbishop again raised during a lecture at the University of Stellenbosch last week, in reference to a recommendation made by the Truth and Reconciliation Commission (TRC).

"A once-off wealth tax imposed on white South Africans who earn more than a certain amount as a small gesture towards reconciliation and redress would almost certainly pass the Van Heerden threshold because whether one supported apartheid or struggled against it, one invariably benefited from it if one is a white South African (whether born before or after 1994)," said De Vos.

Annual tax

He would go even further and suggest that an annual tax be imposed for up to two years.

"Why not impose such a tax of – say – two percent or three percent of one’s annual income for a period of a year or two and then divert that tax into a special fund, administered by a respected panel of experts...

"How many school libraries could be built with that money? How many fully stocked laboratories could be built with that money? How many soccer fields and pavilions could be erected with that money?

"How many new computer labs with internet access could be provided to students who now can only dream of having access to computers and the internet?," asked De Vos.

"The problem is, of course, that some white people – out of shame or ignorance or maybe a bit of both – do not want to admit that white South Africans almost all benefited from apartheid."

      What amazes me is that before Apartheid blacks never had the right to vote, they never had education, never owned any land, never had the right differ from the views of their chief and they were OK with that. THeir own chiefs oppressed them way before apartheid and blacks were happy with that. So why were they unhappy with it when Apartheid denied them the same rights?? Is it because Apartheid was a convenient guilt trip to get something you would never have had before?

    Put simply if there is a tax based on race I am gone. I see no reason to stay in a country that punishes me for something I had no choice in. Whether I benefited or not I had no choice in the matter. When I have other options I refuse to be punished for something I played no part in, benefited or not. I am the only white person in my university class, as far as I see it I am on equal terms with them, so no I won't pay some extra tax that they will not have to pay.

      My dad worked underground in a gold mine all his life and died of pthysis at 60. Throughout my school years I knew there would not be an opportunity to go to university, and when I left school after matric I started working at the CNA. Built my life up from there, everything I own (which hasn't been stolen in too many robberies to mention) was paid for by HARD WORK. I have nothing to regret.

    I have no problem with a wealth tax, but it must not be on the grounds of race, it must be on the grounds of wealth. If a black man is a billionaire in such a short space of time, he has benefited from apartheid, by the reverse thereof, and this has not being to the benefit of the poor or politically disadvantaged. If I have to pay a wealth tax purely on the basis of race, I will refuse and and feel no guilt at the emigration and migration of my and other peoples capital from SA. The same is applicable to certain blacks who were millionaires prior to the democratisation of RSA, if they were already millionaires under the apartheid government, then they should also pay a wealth tax. i.e. Have a wealth tax by all means, but base it on wealth, not on race.

    The premier of the Limpopo is extremely wealthy, rudely so, let him pay a wealth tax, this money has being acquired in a reverse mechanism with political influence. Ditto the Zuma family, only 6 or so years ago they were scrambling a few indians for a 500 000 alleged pay off, which Shaik spent some brief jail time for, now the sons and sons in laws are doing deals worth billions, tax them as well. So by all means proceed, but remember to trade out against the wealth tax all landclaims, BEE and AA regulations and laws, so that we are not disadvantaging my children to such an extent that more of us take our wealth, capital and particularly skills elsewhere. Remember we are also the major current tax payers, and in many entrepreneurial cases the current drivers via small business. Many of these people employ 10 or more people and pay good taxes and are the lowest users of the tax money. (They primarily use private education, private hospitals and private security, because the states "nationalisation" of these facilities has made them useless to the extreme). Remember that you still require rates etc, most of the "wealthy" pay rates at a premium to their own use, i.e. the bulk of Sandton rates money goes elsewhere, to non rate paying areas to provides services.

    Drive between Acornhoek and White River in Mpumulanga and look at the extent of the services provided there to no rate payers. It's huge, and good, I am glad they have it, but do not discount who is paying for it. How many bites at one pie does the government expect to take before they end up biting their own fingers? So yes, tax the wealthy, but then give them some value, deliver to the poor and let them know who funded it. Remove landclaims and the constant threat of nationalistion so that our economy can grow and create more jobs. Just remember, do not insulate yourself to the extent that you start believing that the wealthy only got there because of apartheid, they had drive, focus, motivation, intellect and opportunity, not just opportunity, so do not chase those people away, because there is a point of no return, where the capital, intellectual and monetary, picks up and re-locates. I am pro a wealth tax, but I do not subscribe to the merry bishop's racist view on this issue. (More is the pity that he said it the way he did, because I am a reasonable admirer of the good Bishop)

Nazism believed in the Ayran Race much like people today believe in the Holier than thou "Human Race" and they believe that we are all the same and have no difference and those that believe there are differences must be destroyed and taken care of, even if it means KILLING THEM! Yes, Komasa, today's Liberalism has so much in common with Nazism yet they will do all in their power to smear all Nationalist thinking people with the Nazi brush!

      Doublepost I am not confusing Nationalism and Nazism as Nazism is an ideology on it's own which incorporated nationalism, which has socialistic tendecies but is not socialism. What I am disputing is which side of the political spectrum it resides on.

      Komasa, Hitler was not a Nationalist, for he believed that if you are weak you deserved to be conquered. He did not respect different Nations right to exist. Many people perceive Right Wing politics to be the enemy of "people of colour" and they don't realise that they couldn't be more wrong. Most Nationalists don't want to have blacks slaves or oppress blacks, we want our own country and we respect the right for blacks to have their own countries too, as with indians, chinese and everyone else. We also disagree with uncontrolled Immigration and believe that each country needs to sort out their own issues without interference from others. In other words, Komasa, we don't like Imperialism and actually fought against it with all our hearts, bodies and minds during the Boer War. Right Wing politics believes in the Conservative approach to politics, not the progressive. We like to prove that a certain method works before implementing it on a large scale. The whole idea that we don't move with the times is ludicrous, of course we do. We just do it "conservatively" so as not to destroy the balance that many countries exist upon. When you rush head first into "progressive" policies you end up with the Riots in Britain, you end up with problems you have no way in hell to correct without being massively cruel. Imagine Britain today if they had merely managed their policies correctly and had proper controlled Immigration?!

      Whites brought Education and technical Expertise with them. It's ours and was never stolen from blacks at all. What makes it Whites responsibility to educate blacks? Oh and we already pay close to 50 % of our income earned through various means of taxation, so this will mean that White's are paying more than HALF OF WHAT THEY EARN and get nothing back in return. Oh wait, that's a lie. We do get all the blame!

    I would pay this tax if I never have to hear the words "Its Apartheids fault" and ".. but you benefited from Apartheid." again. But there is 2 reasons I won't 1) Because of the violence, over taxation and high prices of everything in SA I can't afford it. I'm currently in a situation where I might have to sell my car and house because I can't make ends meet 2) I will never stop hearing "It's Apartheids fault", because it is a easy scape goat for lazy people with a chip on their shoulders who is looking at everbody but themselves to blame for their miserable and worthless lives. If you don't respect yourselve(s) nobody else will.

    It will not stop there. Firstly the money will be wasted and into corrupt officials pockets.Secondly you will have to give something else next time. And then more. Even if there is no more white people in SA they will blame things on Apartheid. Thats why they cant progress on there own. We didn't blame the British for everything in SA we went out and work hard and uplift all. 17 years and we going backwards? Be realistic this is only a temporary solution.

    instead of the govern,ment stealing all the money and paying themselves millions in bonuses each year, they should spend it on all these labs and soccer feilds, they blame the whites for everthing but we all know its for there own agenda, even if this wealth tax goes through how much will be spent on a soccer feild and how much will De Vos get in his pocket, cmon people dont be so blind, spend the tax you recieve already on the people who need it and not for your own agenda, im a white south african and i am ashamed of my country, we need to stand as one, not as black and white but as the minority verse the majority, we have the minority while i government steals from us all and takes the majority,
