Cops kills suspected burglar

Johannesburg - A suspected burglar was shot dead when he apparently tried to break into a police officer's house in Florida on Tuesday morning, Johannesburg metro police said.

"An off-duty metro police officer shot and killed the male suspect who was climbing through the officer's laundry room window," said Chief Superintendent Wayne Minnaar.

He said the officer had woken up to sounds in his house at 03:00.

While climbing through the window, the suspected burglar was shot once and died at the scene, Minnaar said.

The burglars' accomplice ran away.

Minnaar said police found a screwdriver and a crowbar at the scene.

      bloodbane - I don't agree at all. Personally I'm glad the $%^&* was shot, don't get me wrong, and I'd probably do the same, but the Law doesn't state you can shoot someone attempting to break into your house.

      Incorrect Bloodbane, the law states you may only use deadly force if your (or someone elses) life is in imminent danger (anyone who has completed their firearm competency certificate has had this drilled into them). As the guy was climbing though the window, the occupants life was not in imminent danger. I am however disaapointed that the cop didn't also shoot the other one...

      It will probably be a justified killing as you can be killed by a screwdriver and or crowbar. As long as the suspect was not shot in his back or outside the home. Good riddance.

      The law states that you may use lethal force if you believe you or someone else's life is in immediate danger (within the boundaries of proportionate force). If the person has already committed murder and is running away with a "deadly" weapon you may also use lethal force to stop him.

      Buzzbar, don't be ridiculous. When the police arrived to find the criminal with that panga/knife in his hand (wink wink), they will know that the officer's life was in imminent danger. It's called self-defense.

      @ deon - that's what I'm hoping for. I just pray that under this massive crime onslaught we're experiencing, the prosecutors / Judges realise we're at our wits end trying to protect our lives and property, and that it's high time we as civilians are entitled to use extreme force in response to the ROE the criminals have established.

      Incorrect chad. The law says that the person breaking into your house must be a immediate and life endangering threat to ur immediate well being or that of your family. Then u have to warn them u are armed. Then fire a warning shot then only if the threat persists. Are u allowed to shoot someone. Impractical I know but true.

      True - the law allows the burglar/armed robber to gain entry, compose himself, look through your valuables, shoot and rape your family, trash the place, rifle (sic) through the fridge and on and on and on....before you can.... what? Use harsh language? Knock off a letter to this forum? Ladies and gentlemen - be aware of one thing. It is the law that is lacking in SA. The law. The police are lazy, ineffective and incredibly undriven, sure. The courts are backed up, and jammed packed full of shiftless civil servants, that's a fact. But it is the law (specifically, the Criminal Procedures Act, as amended)that "makes crime pay". It is the law that is ultimately a piece of rubbish in SA. Be in absolutely no doubt about that.

      Again - I cannot agree. A murder case will/should be opened and then depending on the facts uncovered, it might be dropped or the charge might be altered etc. Again I don't agree with this principle personally, but that's the way it is. To me the Law needs to change in this regard and presumptions need to be included based on the fact that our crime statistics are unacceptably high, and particularly because of the extreme violence and even murder that often takes place during a simple house breaking.

      The law as it stands at the moment is an ass. Every person should have the right to use whatever force necessary to protect not only his life and the lives of his family, but his property as well. Until and unless the law changes, scum will continue to illegally enter properties with the express purpose of theft and possibly murder. There should be no in depth investigation in caes like this, the scum was trying to enter illegally, no one enters a house through the window in the dead of night unles they are up to no good. Put the innocent on the correct side of the law again.

    I presume that the off-duty metro police officer has been arrested and treated like all the other ordinary citizens who have acted the same way - charged with murder. I know that the law requires a charge of murder to be brought but why when a person is defending himself - see my comment below - needs to be arrested I really think that that is going too far. To the police officer - well done - these days it can almost be expected - beyond reasonable doubt - that the burglary will turn into a robbery with the victim and his/her family members being killed or severely injured - so the actions of the officer should be expected.

      Why is it stupid? You do realise we have a serious flaw in our Law at the moment. In theory, we are not allowed to use max force unless our lives are in imminent danger. So how do we know if our lives are in imminent danger? Well, we have to wait, see what happens, and evaluate. Whilst doing this the criminal will probably kill us. It's not so much a debate on what we will do, if you read the comments most will react the same way. It's the injustice of the course the Law takes from that point on (after you've shot the perp) that is totally unfair.

I was arrested for murder and my gun was confiscated for forensic evidence he and his bras break down my main gate kill my dogs cut my safety door to pieces and set of the alarm on the way to my bedroom not the fridge in the kitchen.     Gents, there's no doubt this cop did the right thing (in my book, at least)but unfortunately the law is the law and he may have to go through the process and end up getting a slap on the wrist AND a record. That's why I have a fake gun in my wardrobe. Ive been burgled many times before and when one of these buggers burgles me again I'll blast his head off ..."coz he was pointing a gun at me". Police will find a gun in his hand of course....(get my drift??). Believe me I will sleep well that night.
