Cape Town - A married couple who allegedly embezzled the One&Only hotel group out of R1.2m are hoping to have multiple fraud charges against them withdrawn.

Janine and Wayne Rix appeared in the Bellville Specialised Commercial Crime Court before Magistrate Sabrina Sonnenberg on Monday.

Prosecutor Simon Leope told the court that the proceedings would have taken the form of a plea bargain, but that the State and defence could not agree on an appropriate sentence.

Instead of a prison sentence, as suggested by the State, the defence wished to make representations to the head of the Commercial Crime Unit, Advocate Malini Govender, for the withdrawal of the charges.

At his request, the case was postponed to June 18 for the outcome of the representations.

According to the charge sheet, Janine Rix worked for the hotel group as a financial clerk and her duties included the payment of services provided to the group by creditors.

The State alleges that she diverted payments totalling R1 246 234 into her husband’s bank account by manipulating the group’s electronic system.

Together, husband and wife face 60 counts of fraud and one of money laundering.

The embezzlement is alleged to have taken place between January 2011 and November 2012.
