Court dismisses ex-ANC councillor's bid

Johannesburg - The Eastern Cape High Court in Mthatha has dismissed an application by Mbhashe municipality ANC councillors to be re-instated after they were suspended from the party.

The ruling was made on Thursday.

The 16 councillors lost their seats after their suspension in January. They wanted their jobs back and to be re-instated in the ANC.

The group had been charged with various acts of misconduct and contravening the ANC's constitution in 2012.

Acting Judge Sipho Maqubela said he was unable to find that important aspects in the appeal at the ANC were not considered.

"The [ANC] national disciplinary committee of appeal dealt with procedural fairness and the merits, and acted in accordance with natural justice and in accordance with its rules."

He dismissed the application with costs.

The party welcomed the court's decision.

"This court judgment will send a clear and bold message to any person who may harbour ambitions to break our rules by bringing our ANC into disrepute," spokesperson Lubabalo Mabuyane said in a statement on Friday.

"Our focus is to encourage our councillors to respect the decisions of the ANC and respect the wishes of the voters."
