Court rejects plea for cut in damages for wrongfully arrested sisters

Pietermaritzburg - The Pietermaritzburg High Court on Friday rejected a State plea for a cut in damages awarded to two sisters who were wrongly arrested. 

Durban sisters Antonella and Ruth Mtshali were each awarded R80 000 for the wrongful arrests and R15 000 for malicious prosecution.  

The damages award was made by the Pinetown Magistrate's Court in May 2011. 

The State did not argue that the awards were wrongly made, but rather that the amounts were excessive. 

Judge Jacquie Henriques said there was no merit in the State's argument. Acting Judge S Chetty concurred.

The Pinetown court was told that 8 to 10 officers arrested the sisters at midday on January 21 2008 and only released them at 15:49 the next day.  

Each sister was issued with only one blanket, detained overnight and given no food.
