Court rules in favour of white bursaries

Johannesburg - The Supreme Court of Appeal ruled it was within someone's right give bursaries to only white students, according to a report on Saturday.

The ruling came after Daphne de Villiers from Stellenbosch in her last will and testament determined that the trustees of the Jean Pierre de Villiers Trust, which she created, must allocate R250 000 yearly to white students at four universities for certain degrees, Beeld reported.

These were the universities of Stellenbosch, Pretoria, the Free State and Cape Town.

Five appeal court judges found on Friday that it would not help to apply in court for the bursary to go to pupils of another race as it was not the person's last wishes.

De Villiers was warned before her death that this might be problematic but she was insistent, according to the report.

After her death all four universities refused to become involved with the bursaries due to the racial connotation.

The administrators approached the court to remove the word 'white' on grounds of discrimination.

It was ruled that if white students could not benefit from the bursaries that the money should go to a charity as De Villiers stipulated.

      Its a pity it has come to this. If everyone got a fair chance it would not be necessary for people to do this. This however will lead to many more doing the same thing and in the long run the racist policies of government will actually hurt black scholars and students.

      White students with top marks are often denied entry into varsity, while their black counterparts who barely passed are allowed. A while back there was a big debate about this problem... overall in SA people dont get jobs, leadership positions etc. based on merits but on favoritism of colour.

      Unbelievable that people who are now favoured by the government through BBE and the like want to get their hands on a minority's will beneficiaries while at the same time wanting to deprive the minority's of bursaries for which the minority's most probably paid more than their fair share in taxes in the first place.       @Themba.thwala.98 The truth is there is no non-racial builidng happening even with the current goverment and business institutions. We are south african indian and our parents were disavantaged too, but they ensure they made us go to university. And now when its time for my wife to find a job, as pyschologist with her masters degrees, the companies she applies to, govermental or business, they tell her they are specifically looking for black south africans. Now if you can please point out me if there is any non-racial buliding going on.? It specifically says in our constitution there should be no racial descrimination, but do you think the government or companies care following the constitution? NO I DONT THINK SO. If thats not apartheid, tell me what it is? So dont tell us about non-racial building. When we are being treated like this, why should we care about giving money to those who dont care about our rights. Cause and effect my friend. But you know, what our parents never thought us to beg and expect things for nothing unlike every third person in SA. We will survive. We did it during the old apartheid and we will survive under this new apartheid.

      We should all follow this ladys example that way we can make sure that our children will have a education in life. Cause this anc goverment will only take care of thiere own so we need to take care of our own and secure our childrens futures. Thumbs up for this lady.

      @Themba - actually I think you will find that the courst can do just that when the use is illegasl, contros bonos mores or contrary to public policy. This time the court just found that the provisions of the will were perfectly acceptable.

      Omonaija: How do you arrive at that conclusion when-whites are utrned down daily for jobs because they dont fit the BEE profile?Or rhe fact that when the poorest whites are given housing by the state,there is always a big uproar?       @omonaija - I get where you are comming from, but if if it was left to the Government etc. No white children who deserves a chance to go to varsity will ever be given that chance. That is why it is quite common in the white part of our country for parents to create study trusts at their children's birth to allow them to go and study one day in the far future. But some of the parents cant afford this so to have someone create a trust that will cater for deserving, but financialy strained white kids to get bursaries is a blessing for those parents. If this is not done whole generations of kids will be kept from tertiary education because they are born to a minority that was running the show close to 20 years ago. And be honest - Bursaries very rarely go to white kids these days

      @ omo, you seem to think you are the only educated person in the debate, now I personally agree with what this lady has set out in her will and while other on this forum may lack the correct use of the vernacular, I do not. Racism is alive and well in this country thanks primarily to government and their policies which discriminate against non black in such a way that it has become near impossible to have any opportunity in this country. Until this comes to an end, re bee and aa etc, things will progressively get worse. Now bear in mind, before saying that whites should just leave, the majority of the minority do not have the financial means or education for them to be worth being accepted by a foreign country to do just that.

    Are they kidding??? So its ok for bursaries to be goven to black students-thats not racial? Its a will,therefore it must be executed in the way requested! Why could the universities involved be grateful that needy students with talent will actually have a shot at being something. BEE is just as racist yet we have to tolerate that!!!!

It is painful that companies, government and individuals chose to poison the future of South Africa while students in universities are trying by all means to interact across language and racial boundaries with each other. A company by the name of Exxaro that i'm contracted to selects students based on needyness and perfomance/willingness balance. And in Pretoria where it is based there lots of poor white/black students which it targets. Its companies like these and NFSAS that deserve a space in the future of SA. I think in future there should be a non-profitable, non-governmental body that hands out all donor funds to qualifying students.

    More than 80% of ALL bursaries goes to black, coloured and Indian students. The bursaries actually state that persons of previously disadvantaged back-rounds should apply. Why make such a big fuss about this? I didn't get a bursary, I worked extra hours to pay for my studies. Whoever wrote this article could've been a bit more discreet.

    i am all for equality. as much as this article could cause racial spats between blacks and whites, we should all fight for equality because this country belongs to all of us. I am a born free, never experienced apartheid and i see people equal never the less their skin colour. as a young generation of this country we should not let our past rule us and rather focus on the present.

We are too busy trying to survive by trying find a needle in a haystack job, If everything was done NON RACIALLY and without people trying to earn whats not theirs (corruption etc), south africa, would be the best country in the world.       Sadhir go to the Human Rights Commission then. They can help you to put together a case and take it with you to the equality court. If only people understood the legislation and were brave enough to challenge, we could get far. About the polarised comments here, people are generally civil outside of news24.
