DNA test results link rape accused to another case

Johannesburg - An Mpumalanga man accused of robbing and raping a 22-year-old woman last year was shocked when DNA tests linked him to another rape and robbery case committed in 2012.

Moses Nkosinathi Mathebula, 25, from Dwaleni village near White River, was not asked to plead when he appeared in the Nelspruit Regional Court on Tuesday, a News24 correspondent reported.

He was attending the rape and robbery case involving the 22-year-old woman from Masoyi in September last year.

"DNA results have linked you to another case of house robbery and rape of a 21-year-old woman committed in November 2012," Magistrate Vanessa Joubert told the accused.

In disbelief, the accused responded that the 2012 case was finalised long ago.

"After I was arrested and charged, I appeared in court and was informed the charges against me were withdrawn," the accused told the court.

State prosecutor Cindy Sihlongonyane told the court that the charges against Mathebula were never withdrawn.

"The case was provisionally withdrawn due to delays of the DNA results from the Pretoria laboratory. The results have finally been released and summons have been issued against the accused," Sihlongonyane said.

Magistrate Joubert told Mathebula that the charge sheet stated that he was charged with breaking into a house where a 21-year-old woman was reported to have been robbed and raped.

"It took longer for the DNA results to be finalised, which was the reason why the case was provisionally withdrawn. The results are now back and the charges against you have been reinstated, meaning you are now facing two criminal cases," Joubert said.

Joubert said, in the new case, Mathebula was accused of robbing the 22-year-old woman of her handbag, R30 and a cellphone.

Mathebula applied for Legal Aid.

He was remanded in custody and the case was postponed to April 13 for the two dockets to be handed to his attorney.
