Dad applies for legal aid in rape case

Johannesburg - A Mpumalanga taxi owner accused of raping his daughter asked the Nelspruit Regional Court on Friday for a legal aid lawyer, after his family failed to appoint one on his behalf.

Magistrate Andre Geldenhuys asked the accused why he still did not have a legal representative.

"Where is your new attorney? I see he is not here. Have you spoken to him or your family, to find out what is delaying him?" Geldenhuys asked.

The taxi owner was not sure what was going on.

"I don't know. The last time I asked my wife to organise me one, but I am surprised to see he is not here," said the 53-year-old man from KaNyamazane outside Mbombela.

He is accused of raping his daughter, now 23, from the age of 11, impregnating her three times since 2001 and forcing her to undergo abortions.

Legal aid

After attempting to get answers from his family in court, the man said, "I have decided to change my mind. I would like to apply for a legal aid representative."

Geldenhuys postponed the matter to 24 May to enable the man to apply for a legal aid lawyer.

The case has been postponed several times for him to appoint a new legal representative after his previous lawyer withdrew from the case.

The man, who has refused to have a court interpreter, stating he would testify in English, has not yet been asked to plead.

The man, who has two sons, was arrested in March last year after his daughter reported being raped.
