Defence dealt a blow in Simba Mhere court case

Johannesburg - The defence team of Preshalin Naidoo, the man involved in the car accident that claimed the life of Top Billing presenter Simba Mhere, was dealt a blow in the Randburg Magistrate's Court on Thursday.

Naidoo's two-day trial had been scheduled to start on Thursday but his lawyers requested a postponement, saying their expert report was not ready.

"Our expert, who is a very prominent person... his mother passed away and he did not have ample time to comprehensively address (the report)," said Naidoo's lawyer, Francois Roets.

But Magistrate Ndivhuwo Setusha said the matter would not be postponed. She said it was first brought to the court on June 4, 2015, and had been postponed numerous times since then.

"Looking at the history of this case, it is not the first time that more than one day has been allocated for the trial but it results in it not proceeding," she said.

She said while she sympathised with the expert who had lost his mother, his personal issues could not disrupt the case.

Roets then recused himself from the case, leaving the instructing attorney, Satch Govender, to continue.

Relatives and friends of Mhere were present in court for the trial, including his Top Billing colleague, Jonathan Boynton-Lee.

Thursday would have marked Mhere's 27th birthday.

The collision between Mhere and Naidoo's vehicles took place along William Nicol Drive, north of Johannesburg, in the early hours of January 31. Mhere's best friend, Kady-Shay O’Bryan, also died in the collision, while Mhere's father, Joseph, survived.

Mhere rose to fame when he won a presenter search competition in 2010, landing him a job on the lifestyle television programme.
