Girlfriend's body put out with trash

2012-10-12 08:27

Pretoria - A man has been sentenced to 8 years in prison for killing his girlfriend and dumping her body in a dustbin and putting her out with the rest of the trash.

A Pretoria judge said suspended prosecutor Geoffrey Maponya deserved a stiffer sentence than the one that the office of the Director of Public Prosecutions had agreed to and said an effective three years behind bars was far too lenient for the murder of Precious Sibanda, 22, reported the Pretoria News.

Sibanda died after she was punched, kicked and throttled and finally suffocated after a plastic bag was pulled over her head.

Maponya tried to stuff her body in a freezer but it didn’t work after which he put her in the dustbin.

He told the court that he had not meant to kill her and had put the plastic bag over her head because he couldn’t look at her face.

On the day of the murder Maponya did not go to work but spent the day drinking and smoking dagga with Sibanda.

They had an argument because she wanted to go home and he began assaulting her.

Maponya argued in court that he did not intend killing her and was guilty only of culpable homicide as he was “negligent” when he had put the plastic bag over her head, not knowing that Sibanda was still alive and that it could kill her.

8 Years is not enough for killing someone!

      hentie.devries - 2012-10-12 08:36

8 Years is ridiculous! Especially for the violent way that she was killed

      nrgx.nrg - 2012-10-12 08:43

      Life is cheap in SA!

      Rabbler.Rouser - 2012-10-12 08:45

      Absolutely outrageous. It's a disgrace.

      patson.nedzamba - 2012-10-12 08:49

Oh pls, how do we expect 8 years sentence to deter people from commiting such gruesome crimes. Chances are he will serve 2 years and get parole or Zuma's pardon.

      Willie - 2012-10-12 09:12

      I told you anything that's start with "J" is !!!!!!! 1 > Justice system 2 > Jub-Jub 3 > Jackie 4 > Julias 5 > Jacob Ag the list is long

      gerald.umraw - 2012-10-12 09:41

you got to be kidding me, is our justice system for real? Stupendous belief that he did not know placing a plastic bag over someones head would not kill them. And to think he had so little regard for life that he dumped the body into the trash like it was wortless trash. And you get 8!

      pinky.kgole - 2012-10-12 09:44

the dude had a really good lawyer

      chilli.stephenson1 - 2012-10-12 09:49

3 years for murder... changed to 8 years. This country really is in a mess aint it! You get life for drugs, and for theft, but murder.. oh just a couple years. WTF is going on in this messed up country!

      firstseed.mbeva - 2012-10-12 16:15

Just last month, another murderer in Limpopo killed his wife by using a bakkie to run over her. Guess what, he was slapped with only six years

  • sandra.j.rennie - 2012-10-12 08:34

8 years for murder or 8 years for dumping the body ? A lenient sentence is an understatement !

  • richy.rex.77 - 2012-10-12 08:34

But really only 8 years? This is equal to nothing. Good behavior - 3 Participation in rehabilitation programs - 3 He has to serve 2 years in all.

      sharon.erwin.96 - 2012-10-12 08:40

      Jacob's remission of sentence - 6 months...

  • Hemlock - 2012-10-12 08:35

3 years...for murder? For taking a life? This bastard should be locked up for life in a max security prison doing hard time! Filth of the earth! Please bring back the death sentence.......

  • carvern - 2012-10-12 08:35

What the F is going on with this article intercalating an anti "dagga" smearing campaign again. As part of the cause to her death

      p.borchard - 2012-10-12 08:47

carvern what your on about? Maponya claims being under the influence of booze and dagga as an excuse for doing it - so blame him for 'smearing' dagga.

      hein.huyser - 2012-10-12 09:18

@Cavern, I agree with you, it is only this backward courts of ours that think using dagga is not good for you. The rest of the world is agreeing that dagga is great for you, in fact, it must be administeted to our young, even whilst being in the womb, and after birth, every day in secondary and first-hand use. In fact, it has been proven that all the great inventions in medicine and science can be atributed to the use of dagga. The whole world knows how good it is for you. It stimulates mental capacity, your physical attributes improve and in fact, this stuffis available for free or cheaper than normal cigarettes, all over the world. Eish we have some backward laws in SA? Don't we?

      p.borchard - 2012-10-12 09:37

Hein, if your little innocent weed is so innocuous why do people who appear in court for all kinds of horrific crimes always claims that they were 'impaired' because they had a bit of the 'giggeltwak' before stabbing their girlfriends/broke into old people's homes and raped them et.?

      jarrod.ward.372 - 2012-10-12 11:30

@hein what the hell are you on about? administered to our young? really?

      arne.verhoef - 2012-10-12 15:36

PB, at least alcohol is safe. Youre ignorant.

  • karen.gerhardi - 2012-10-12 08:38

We will never stop violence against women and children if this kind of sentence is all that can be expected. They are basically sending the message that's its ok to assault and kill a woman.

  • sean.fleischack - 2012-10-12 08:40

An effective 3 years behind bars for murdering another human. No wonder crime is rampant and out of control.

      hein.huyser - 2012-10-12 09:39

Especially abuse against woman and children. But if the top is rotten......

  • ardenharvey - 2012-10-12 08:43

publicly disembowel the animal.... Let his innards fall to the floor for all to see what happens when you are a murderer...

  • vaaldonkie.visagie - 2012-10-12 08:44

    Very classy.

  • gift.mushi.9 - 2012-10-12 08:45

This is a worst setence i've ever heard. Second from the one that a farmer from Hoedspruit (Mark-Scott Crossley Scott-Crossley finished his parole in Bushbuckridge, Mpumalanga, this week and is now a free man. Mathebula was one of the four suspects accused of murdering Nelson Chisale and feeding him to lions in Hoedspruit, Limpopo, in 2004. Scott-Crossley is quite popular in the Hoedspruit area. In 2004 Scott-Crossley, Mathebula, Simon Mathebula and Robert Mnisi were accused of assaulting Chisale before throwing him into a white lion’s enclosure. Scott-Crossley had fired Chisale from his construction business at the Engedi game farm. Chisale had been helping with the building of a lodge on the farm when he was fired. He was killed when he returned to collect some of his belongings. In 2005, the Phalaborwa Circuit Court found Scott-Crossley guilty of murder and handed him a life sentence. Scott-Crossley appealed his sentence and the Supreme Court of Appeal (SCA) set aside his murder conviction for the lesser offence of being an accessory. It found that Scott-Crossley had only used his bakkie to transport Chisale’s body to the lion’s enclosure after he had already been assaulted and killed by the three co-accused. The SCA substituted five years’ imprisonment on the lesser offence. Scott-Crossley was placed on parole in 2008.

      ettiene.esterhuizen.7 - 2012-10-12 08:55

and you point is?? atleast he did some time, how many rapists, murderers kills farmers and then the so called "excellent" police force cannot trace them?????? The killing of farmers is a goverment ploy!

      hein.huyser - 2012-10-12 09:41

And? He was an accessory to murder. He did not strangle or placed a plastic bag over the victims face to suffocate him, in fact, Scott did not kill this guy at all. So why try to draw a parallel between these two cases? If Scott killed someone himself, its a different story. Seems you don't have the mental capacity to distinguish that these two cases have got nothing in common? Unless of coarse you want to say that the courts are lenient towards white people, so why not towards blacks. If that is the case you are even more pathetic than what we think. But lets call it like we should. Your selective thinking is clouding your judgement, or must I say, your racism towards people of other color is making you stupid? You choose

  • hermann.hanekom - 2012-10-12 08:46

  • Grant Wykerd - 2012-10-12 08:46

  • clive.kihn - 2012-10-12 08:47

Eight years for murder!!!!!!? Life sure is cheap in this country.

  • delish7564 - 2012-10-12 08:47

What total and utter bulls**t, both for the sentence and the murderer's argument that he "didn't know putting the plastic bag over her face would kill her"......... doesn't take a genius to work that one out. Shame on him and the Judge, disgraceful!!!!

  • nontobeko.dlalisa - 2012-10-12 08:47

What is 8 years, how can u take someone's life and get this easy and nice sentence

  • gift.mushi.9 - 2012-10-12 08:50

Probably he was given a lighter setence as prosecutors failed to prove beyond reasonably doubt, as they showed pictures of PIKI TUP bins in court as the bins where Maponya stuffed the body whereas City of Tswane does not use PIKI TUP as their solid waste collector. Hmmmmmmm. Food for thoughts.

  • steveroodt - 2012-10-12 08:51

Prosecutor Drinking and smoking Zol no wonder this countries law system has gone up in Smoke ?

  • chris.buchner.12 - 2012-10-12 08:52

Good to know I can kill 20 people and be out when I'm 86 maybe earlier though killing someone in SA was life specially if he had intended to kill her but I gues his friends helped if you were a prosecutor

  • edmund.roux - 2012-10-12 08:54

SA is a country where trivial things are treated as priority while the really urgent matters are overlooked. No death penalty in a country where daily innocent people are slaughtered, because we wouldn't want to infringe on their rights?

  • Mpotsiseng - 2012-10-12 08:57

WTF is up with our justice system?? So dude gets 8 years because he did not "intend" to kill her?? That's not right :(

  • waha.manavhela - 2012-10-12 08:59

So wondering how can a Judge gave such setence!,this are the consequences of corruption, sumting is cooking between Mr Judge n Maponya

      hein.huyser - 2012-10-12 09:44

Seems so isn't it? But can this possibly be because we have a president for this matter in the President of SA? So important to choose the right person

  • Ntokozo Khumalo - 2012-10-12 09:04

wow SA justice system. human life is worth 8 years in jail???? appalling.

  • khutso.b - 2012-10-12 09:07

8 years? oh Lord, protect us!

  • hein.huyser - 2012-10-12 09:09

"prosecutor", smoking dagga, did not know that pulling a plastic bag over her face can kill her! These things do not belong in one sentence

  • Small.Mbongwa - 2012-10-12 09:10

This goes out to show sub-standards in our Justice System> someone clearly did not do his job properly whether from the Prosecution side or the Judgement side>either way it goes out to show that there is no uniformity in the application of law in SA and this is sickening>

  • - 2012-10-12 09:11

8 years?? After he suffocated her cos he "couldnt look at her face" and then proceeded to stuff her in a bin ... It should be his life for her life!! Finish!!

  • johan.erskine - 2012-10-12 09:11

    8 Years????? Only in Africa

  • ken.koen - 2012-10-12 09:21

Life is not cheap in South Africa, it simply has no value at all. In fact we might as well do away with laws and courts and the justice system anyway, because this is a lawless society throughout, from the president down.

  • wikus.terblanche.7 - 2012-10-12 09:22

Let him hang on a rope in the middle of the city, that is the only thing that will shape up SA. This judge is a joke.

  • warwick.railton.7 - 2012-10-12 09:27

Our judges need judging. They are clearly against law abiding citizens. They have lost touch with reality.

  • vanessa.govender.73 - 2012-10-12 09:27

8 years for murder for a prosecutor? What a strong message that sends! Fighting violent crime starts in the courts, harsh sentences for murderers and rapists. 8 years is an insult to the victim, her family and a mere rap on the knuckles for this deranged lunatic1

      hein.huyser - 2012-10-12 09:46

This is an insult to all law abiding citizens. Where is the Womans league in all of this, and this judge needs to be barred from the bench.

  • briana.scott - 2012-10-12 09:29

Shocking, only 8 years. how disgusting, he just put her out like garbage!

  • leonard.maseko - 2012-10-12 09:30

Haha really? He didnt know that punching, kicking and strangling somebody with a plastic bag over their head could kill them? People I dont blame this guy for getting 8yrs, all he did was try his luck and rolled the dice with a ridiculous story. I blame the A-hole Judge who should see through that kind of rubbish because he is 'educated'! Surely our judicial system doesnt have loop-holes that big? Anyone educated in Law able to explain this?

Effective 3 years? Really? Oops, sorry, it was an accident when I kicked and throttled her. Really? OK. So let's just lock you up for a little bit, seeing that it was an accident and all. No worries. Maybe when you come out, and your next girlfriend pisses you off, you can get the 50 years you deserve.

  • issa.kabudula - 2012-10-12 10:22

From today - whoever killed a person even if u were alone when killing tat person no matter how young U will @ the end of the time reveal yourself and you will be arrested and jailed its an automatic.

  • carolyn.dewrance - 2012-10-12 10:31

suspended prosecutor Geoffrey Maponya deserved a stiffer sentence. Well I hope this man never comes out of prison alive, May the rest of the inmates put a bag over his head one night when he is sleeping and that he never wakes up again. Shows you if you have friends in the job, you can get away with murder.

  • BulletProof. - 2012-10-12 10:32

People get more years in jail from fraud. He should got a death sentence.
