Hummer driver 'had no control'

Johannesburg - The driver of a Hummer vehicle which crashed into three motorcyclists in October 2010, killing two and causing a third to lose a limb, has pleaded not guilty in the Pretoria North District Court.

Indi Himalindi Chiyabu, 31, is charged with murder, reckless driving, leaving the scene of an accident and failing to report it.

Video footage detailing the moment of impact and subsequent fire was obtained from a security camera in Rachel de Beer Street, in Pretoria North, and was shown to the court on Monday, Beeld reported.

"The Hummer's momentum lifted the motorcycles, with their riders, and propelled them back in the direction they had come from," Warrant Officer Terry Murphy testified.

Two of the motorcyclists, Pieter Coetzee and JP Kruger, died at the scene, while Coetzee's son Pieter jr survived, but lost a limb.

"The Hummer did not follow the natural curve of the road, but crossed a solid white line, right in the path of the oncoming motorcyclists," Murphy testified.

Families of the victims wept in court when they saw the video footage, which included images of the dead bodies, the paper reported.

"I could not determine the exact speed of the Hummer, but the driver was clearly in no state to exercise control over his vehicle," Murphy said.

The case was postponed until 2013.

      The liciencing process is failing us. There are to many people on the road who can't drive and who are driving vehicles that are too much for them. Driving a Hummer is more akin to driving a truck or a mini bus, but it gets driven like a car. I have seen idiots going around a corner with inside wheels off the ground.

      Maybe it was a fake or illegally issued licence and then the victims should aslo sue the person and authorities that issued the illegal licence. The State does not do enough to eradicate bad driving - hence this type of incident.

      I think you are out of line,it's in fact you who needs psychiatric help, anyone is free to drive what he likes and do it responsibly. The rule of law will prevail in this case just like it did to some 2 idiots who killed school Children in SOWETO. This was murder and i hope he will get punished for this.

      Besides the fact that I missed a p, my point is that as much as we are free to drive what we like, there should also a sense of what is right. Driving a Hummers says to me: I love excess, I don't give a damn about the environment, I have a problem with my ego, and god help anyone who get's in my way 'cause this vehicle is capable of taking out ten pedistrians at once.

    The fact that this case has taken so long to be heard in court is a travesty of justice. The driver should have been apprehended soon after the murder and have been refused bail because he speeded off without stopping. This is not "an accident", it's manslaughter at the best caused by an un-coordinated thug that should most probably not have been awarded a driving license in the first place!

    How in the hell did he afford to buy a hummer. I bet he didn't even have a valid licence or has learnt how to drive properly. Problem is he most probably does not even know the rules of the road.

      In the last year that they were sold here, new, 2009 /2010, they were going for R380k, less than a lot of bakkies. They are a dream to drive, I have never felt unsafe, ponderously slow in take off, max out 140 after a couple of minutes....but what you need to remember is that you have 3tonnes on the road.

I live in Alexandria and you should see how the Blacks drive when coming into town either from Port Alfred or from Port Elizabeth direction, exceding the speed limit in town as if they are still on the open road, and overtaking vehicles on the left hand side and most times it is between 5 @ 6 vehicles at a time geen donnerse verstand nie.

    And then, in 2013 the case will be postponed again and this will happen numerous times until the court decides that the poor Hummer driver's trial has been postponed too often and that he has been deprived of the right to a speedy and fair trial.
