Jub Jub to appeal 25-year sentence

Johannesburg - Molemo “Jub Jub” Maarohanye will appeal after a 25-year sentence was handed down in the Protea Magistrates' Court on Wednesday.

Maarohanye and co-accused Themba Tshabalala were effectively sentenced to 25 years in jail for a street-racing incident in which four pupils had died and two were left brain damaged.

They were both sentenced to 20 years for the murders and four years for attempted murder. For the use of drugs, driving under the influence of drugs and racing on a public road they received a year (three years, to run concurrently).

Jub Jub's lawyer, Rudi Krause, said both would appeal.

Earlier on Wednesday, Maarohanye said if he were to escape a jail sentence, he would write a track about the tragedy.

Maarohanye read out a list to the court of what he would do if he were to escape a jail sentence.

This included erecting tombstones for the victims and holding a benefit concert.

He admitted to driving under the influence of alcohol but said: “I urge the honourable court to take into account that I have never been involved in a motor vehicle accident.”

State prosecutor Raymond Mathenjwa put it to Maarohanye that he had not shown remorse.

Said Maarohanye: "I want to apologise based on the fact that I was part of the accident."

Arguing in mitigation of sentence, Krause asked the court to “have an eye on the future” since his client could not undo the past.

He asked the court not to sentence Maarohanye to life imprisonment.

But Mathenjwa said Maarohanye had failed to own up to his part in the incident, blaming everything on Tshabalala.

He said all the parents of the deceased wanted was for Maarohanye and Tshabalala to say: "We are sorry for our actions."

He argued that they deserved life sentences as there were no exceptional circumstances which proved otherwise.

      Perhaps if he had done any one of the things he said he would do for the victims, the courts might have possibly been a little lenient, but it really is far too little,way too late, as long as he sits in jail, let him appeal to his hearts content

    I like this sentence not for what it will do to these two characters but for the message it sends out there to those monied people who think they're above evryone else. Noone in his right mind drives the way they did when the streets were so full of people. Why didn't they go to Kayalami and do it there? I wish all traffic offences were treated with this severity. The hero of this whole thing is the magistrate.

    It is very typical of anyone that is rich and popular. I just hope the NPA can send away Jub Jub for a long time, our justice system has failed us everytime. It is about it restored that faith we used to have in it. It won't be surprising if people of Soweto decide to set him on fire if he walks free. Justice needs to prevail

    So lets see... he wants to write a song about killing four innocent people and leaving another two brain damaged...how fitting a reminder for their families to hear this...(not) and why would he think erecting a tombstone, and having a benefit concert equates to what he has done...how insulting to his victims families... He must reap what he sows... I hope that he appeals and they actually increase his sentence... some people have no shame or morals...

    Appeal might just be another negative effect towards tax payers. It's actually 27 years in its entirely. People say life is priceless but our judicial system has put a price on it today and on several other occasions. This dude will be released early on good behavior, if it were an ordinary citizen that committed the offense, he would have been prosecuted from day one without the case being prolonged. I hope he suffers in Jail, may every day and night be a living hell for this waste of DNA.

      Most of the child killers end up being so abused by other prisoners that they have a good chance of getting killed or committing suicide. He will come out a changed man, he will never be the same again. Prison can be brutal.

    Shame...he deserves a sentence but he should have been given harsher community service as he is an asset to the country...maybe he should have been ordered to see to the victims families as well ...his imprisonment does not help the victims at all

    if he appeal the sentencing this will denote no remorse and not ready to acknowledge his wrong doing of racing, under influence of drugs as a crime in resulting a fatal accident. The appeal judge might aggrevate the sentencing.

    The victims in this case have no right of appeal! Getting into a car after taking drugs/ alcohol and then proceeding to race down a road shows an attitude of disregard for the safety of your fellow man. You made that choice and in that changed the lives of the members of 8 families. You do not feel that your family should be deprived of you but what of the other 6 families ?

      my brother you are right the is no need to insult him at the end he is a child of .God what he did is wrong, but let us stop all the insults what happen to him can happen to anyone who drink alcohol, and that wont make that person better than jub jub, let him go serve and come out and start his life . Our God said we must forgive many times. we know people who killed people on purpose, for votes' but we not saying anything about that .but this child is been crucified with insults is not fear .     25 years is a heavy sentence in RSA jails. Record show he will only serve a 1/3 of this before release. I would not like to be in Sun City of 8 years! I think justice has been served. Now go to jail....
