Jub Jub to appeal 25-year sentence

2012-12-05 19:00

Johannesburg - Molemo “Jub Jub” Maarohanye will appeal after a 25-year sentence was handed down in the Protea Magistrates' Court on Wednesday.

Maarohanye and co-accused Themba Tshabalala were effectively sentenced to 25 years in jail for a street-racing incident in which four pupils had died and two were left brain damaged.

They were both sentenced to 20 years for the murders and four years for attempted murder. For the use of drugs, driving under the influence of drugs and racing on a public road they received a year (three years, to run concurrently).

Jub Jub's lawyer, Rudi Krause, said both would appeal.

Earlier on Wednesday, Maarohanye said if he were to escape a jail sentence, he would write a track about the tragedy.

Maarohanye read out a list to the court of what he would do if he were to escape a jail sentence.

This included erecting tombstones for the victims and holding a benefit concert.

He admitted to driving under the influence of alcohol but said: “I urge the honourable court to take into account that I have never been involved in a motor vehicle accident.”

State prosecutor Raymond Mathenjwa put it to Maarohanye that he had not shown remorse.

Said Maarohanye: "I want to apologise based on the fact that I was part of the accident."

Arguing in mitigation of sentence, Krause asked the court to “have an eye on the future” since his client could not undo the past.

He asked the court not to sentence Maarohanye to life imprisonment.

But Mathenjwa said Maarohanye had failed to own up to his part in the incident, blaming everything on Tshabalala.

He said all the parents of the deceased wanted was for Maarohanye and Tshabalala to say: "We are sorry for our actions."

He argued that they deserved life sentences as there were no exceptional circumstances which proved otherwise.

he had a life ahead of him as a misician.. i feel for him but there is nothing that can be done. this will serve as an example for those how might think of following their footsteps... everyone must think twice before sitting behind wheels high on druggs or under influence....

      joe.smit.549 - 2012-12-05 19:12

Shame. I feel nothing for him!

      PrettyUsefulArt - 2012-12-05 19:19

I hate these men for not manning up and taking their darned punishment. Surely it's the least they can do? Grrrr. One minute they're sorry and the next they're appealing? Grrr again!!!!

      tert.lepa - 2012-12-05 19:37

25 YEARS is nothing. They should sit for life without parole. End of story. They took life away from others because of theire selfish behaviour. Rott you bastards.

      aniken.vader.31 - 2012-12-05 20:20

The deceased and the brain damaged victims ALSO wanted to list the things they wanted to do. Jub jub you are an shining example of how the rich regard the poor. Before he should attempt to appeal perhaps he should remember cwele and how HER appeal went.....

      dave.elmore.5 - 2012-12-05 20:55

Perhaps if he had done any one of the things he said he would do for the victims, the courts might have possibly been a little lenient, but it really is far too little, way too late, as long as he sits in jail, let him appeal to his hearts content

  • - 2012-12-05 19:07

Tjo still wanna appeal? They will finish up the remaining cents of yours shame

  • Barry - 2012-12-05 19:08

I was wondering if this would drag on any longer, and apparently yes!

  • sminx.r.mandla - 2012-12-05 19:08

Let's hope the judge gives u 35 years this time around, u deserve to rot!!!

  • denis.delaport - 2012-12-05 19:09

You caused the death of four people, why don't you engage with reality and take accountability for your actions. Show leadership, and add value to the young people of SA. Do the time with dignity.

  • mlungisi.botha - 2012-12-05 19:11

I like this sentence not for what it will do to these two characters but for the message it sends out there to those monied people who think they're above evryone else. Noone in his right mind drives the way they did when the streets were so full of people. Why didn't they go to Kayalami and do it there? I wish all traffic offences were treated with this severity. The hero of this whole thing is the magistrate.

  • amith.parag - 2012-12-05 19:11

Do the crime serve the time simple if it was not a famous person they wud go straight to jail be men face the action

Lol @Mike it doest work that way,u r way too far

  • reubenk3 - 2012-12-05 19:25

It is very typical of anyone that is rich and popular. I just hope the NPA can send away Jub Jub for a long time, our justice system has failed us everytime. It is about it restored that faith we used to have in it. It won't be surprising if people of Soweto decide to set him on fire if he walks free. Justice needs to prevail

  • claire.marshallwienand - 2012-12-05 19:28

So lets see... he wants to write a song about killing four innocent people and leaving another two brain fitting a reminder for their families to hear this...(not) and why would he think erecting a tombstone, and having a benefit concert equates to what he has insulting to his victims families... He must reap what he sows... I hope that he appeals and they actually increase his sentence... some people have no shame or morals...

  • lerato.mlakeng1 - 2012-12-05 19:28

they must rot in prison, those 2 irresponsible idiots! every action hs a consequence!

  • Lesego Wesinyana - 2012-12-05 19:34

jub Jub n co accused they deserve the sentence they got, n I hope dis will come s a lesson to all the socalled Celebrities, cos they mostly commit crimes n get away wif it just lyk nothing happens, I wish the court of appeal wil deny them the appeal.

  • burlin.russouw - 2012-12-05 19:37

    only 25 years? dafaq!?!?

  • modise.kefhitilweleso - 2012-12-05 19:38

I thought it was Protea not Pretoria

  • phuti.mashau - 2012-12-05 19:39

Write a song about the tragedy?! Benefit concert?! Dude, are you being for real?! Such an opportunist i tell you!

  • lorna.sisusa - 2012-12-05 19:43

Appeal might just be another negative effect towards tax payers. It's actually 27 years in its entirely. People say life is priceless but our judicial system has put a price on it today and on several other occasions. This dude will be released early on good behavior, if it were an ordinary citizen that committed the offense, he would have been prosecuted from day one without the case being prolonged. I hope he suffers in Jail, may every day and night be a living hell for this waste of DNA.

      douglas.reid.921 - 2012-12-05 20:17

Most of the child killers end up being so abused by other prisoners that they have a good chance of getting killed or committing suicide. He will come out a changed man, he will never be the same again. Prison can be brutal.

  • helene.lee.982 - 2012-12-05 19:44

You journos should learn the difference between concurrently and consecutively. This guy will EFFECTIVELY only sit for 20 years because his sentences all run at the same time, not one after the other.

  • lynda.pitcher.1 - 2012-12-05 19:44

What they did was no less than taking an AK 47 and opening fire on a group of innocent kids......just for fun. I feel nothing for them, 25 years is getting off lightly for killing 4 and disabling 2 youngsters

  • mammudi.makgaleng.3 - 2012-12-05 19:49

You still have time to waste money???? Save it for your future and serve your term.

  • zingisa.pose - 2012-12-05 19:53

He mayd his bed so he mst lay in it...Justice has bin served!!!!!

  • grant.montgomery.5074 - 2012-12-05 19:53

Jub Jub said he did not want to go to jail. If quoted correctly, the magistrate should let him go home ;)

      zingisa.pose - 2012-12-05 19:58

  • lchimukundi - 2012-12-05 19:56

  • bonganiemmanuel.mazibuko - 2012-12-05 20:01

they must not think of themselves alone, they must take into account that they killed pupils

  • steve.j.kekana - 2012-12-05 20:07

That sentence is not enough,Jub jub didn't show any remorse over his actions, turning court into fashion parade was worse while the families of the deseased are morning.Let him go serve his sentence like Mzwakhe Mbule did.

  • fyrguy65 - 2012-12-05 20:10

if you can't do the time...don't do the crime... !

  • simon.selahla - 2012-12-05 20:11

By appealing it shows that jubjub and his co-accused has no remorse for what they did, they still has pride and showing no respect for the justice of this country, I so wish that the court of appeal could add more years to their sentences.

  • groot.vangauteng - 2012-12-05 20:13

  • lunga.matsikechangu - 2012-12-05 20:52

  • Ndiafhi Byron Sikhitha - 2012-12-05 21:00

I am disapointed on ths sentence.I thnk SADC countries made jails 4 the poor.Y Mngeni got a life sentenc for one murdr thn Molemo few yrs or is it tht he is a celeb.Personal mina I c tht jails are for us.

      lineo.sokemane - 2012-12-05 22:26

Its not up to us whether jub jub shud be given a life sentence or 25 yrs, just forgive d guy n all d parties will learn to live with d pain nd eventually we all going to forget ds tragedy! SOUTH AFRICA THIS GUY DESERVES A SECOND CHANCE...SURELY HE LEARNT HIS LESSON

  • graphicmaster.evans - 2012-12-05 21:07

Is is because Jub Jub is a celebrity? This isn't fair at all, he deserve LIFE SENTENCE and the question is, why 25 years?

  • Adeeb Saban - 2012-12-05 21:08

Jub Jub, welcome to the house of Sodom

      mcollen.mcollen - 2012-12-05 21:14

      Adeeb Saban - 2012-12-05 21:28

Mcollen, I think u must be retarded

  • vkhuzwayo - 2012-12-05 21:25

Shame...he deserves a sentence but he should have been given harsher community service as he is an asset to the country...maybe he should have been ordered to see to the victims families as well ...his imprisonment does not help the victims at all

  • duncan.phopi - 2012-12-05 21:31

if he appeal the sentencing this will denote no remorse and not ready to acknowledge his wrong doing of racing, under influence of drugs as a crime in resulting a fatal accident. The appeal judge might aggrevate the sentencing.

  • maringaxp - 2012-12-05 21:47

Life s a bitch. Ppl died. Other ppl will nw hev boyfreinds

  • Papiki Hlahane - 2012-12-05 21:53

      Wally Wal - 2012-12-05 22:13

Look after your ass guy' s . life is tough out there .never mind the appeal get sponsers from Elizabeth Ann

  • Mary Milne Archibald - 2012-12-05 22:01

The victims in this case have no right of appeal! Getting into a car after taking drugs/ alcohol and then proceeding to race down a road shows an attitude of disregard for the safety of your fellow man. You made that choice and in that changed the lives of the members of 8 families. You do not feel that your family should be deprived of you but what of the other 6 families ?

  • nceni.prudence1 - 2012-12-05 22:14

Thanx 4da 25yz in prizin jub jub nd u dn't even deserve this ufanelwe yi life sentence in jail u c that ipride won help u go to jail mybe u wil lern respect where u going to.

      maletsatsi.malambe - 2012-12-06 11:55

my brother you are right the is no need to insult him at the end he is a child of .God what he did is wrong, but let us stop all the insults what happen to him can happen to anyone who drink alcohol, and that wont make that person better than jub jub, let him go serve and come out and start his life . Our God said we must forgive many times. we know people who killed people on purpose, for votes' but we not saying anything about that .but this child is been crucified with insults is not fear . It was just unfortunate that it was him . sorry small go serve and pray much inside for deliverance God will make a way for you.

  • johannes.masilo2 - 2012-12-05 22:34

i think it is a fair sentence and nobody is above the law.there is a punishment 4 wrongdoing..u can even consult the bible it wil tell u that..appealing to this wont help, but make this worse

  • brionyl.french - 2012-12-06 04:45

This sentence is a joke, He should have gotten 4 life sentences at least!!!! How can you say that is fair when Annie Dewanis killer got life and he only killed one person... There needs to be a set standard, You take a life you get life you take many lives you get many lives in prison or we just hang you!!!! I wish we could hang this a-hole

  • graeme.stockwell - 2012-12-06 06:15

25 years is a heavy sentence in RSA jails. Record show he will only serve a 1/3 of this before release. I would not like to be in Sun City of 8 years! I think justice has been served. Now go to jail....
