Pietermaritzburg - The men who hacked eight people to death at Umzinto on the KZN South Coast can appeal the life sentences imposed on them for seven of the murders.

Judge Jacqueline Henriques on Friday accepted a submission by advocate Zina Anastasiou that another court might find that the seven life sentences imposed on Thulani, 28, and Sibonelo, 26, Mncwabe were inappropriate and conclude that lesser sentences were justified.

The accused did not apply for leave to appeal the 20-year prison sentence imposed on them for the murder of their uncle Mantinga Mncwabe, 72, which was motivated by their belief that they were bewitching their family.

State advocate Mbongiseni Mthembu opposed the application for leave to appeal. He said the people the accused had butchered were mainly women and young children who were eliminated because they were witnesses.

“Even if it was dark inside the rondavel, a 1-year-old child is so small that they must have been able to distinguish between children and adults ... The people must have cried out and the children’s cries would have been different to the adults,” said Mthembu, adding that the case has drawn attention and shocked people all over the country.

Judge Henriques agreed it is a very serious case and said this was one reason why “three heads might be better than one” when considering an appropriate sentence.

She granted the accused leave to appeal to a full bench (three judges) of the KZN high court.

She said when the accused went to commit the crimes their intention was to harm only (their uncle and aunt) Mantinga and Sibonisile Mncwabe, and not anyone else. In addition the murders were all committed in close proximity of one another in both time and place.
