Pietermaritzburg - It was an aggravating factor that a policeman, who was obliged to protect and serve, should murder the woman he was in a relationship with, the Pietermaritzburg High Court heard on Monday.

Prosecutor Happy Mazibuko said there was no compelling evidence that the court should deviate from the prescribed minimum sentence for convicted Durban police officer Sergeant Selby Mhlongo, 43.

He was found guilty of murdering Princess Ngcobo in January 2012, after he became angry when she walked out on him after discovering he had paid lobola for another woman.

Defence counsel Mandile Dekela said there were mitigating factors in that Mhlongo suffered from a variety of maladies, was a first time offender, had not planned the murder and had nine children.

On Friday, the court found that Mhlongo had shot Ngcobo - the mother of a two-year-old son, in Florida Road, Durban in January 2012 - in the forehead with his service firearm.

Mhlongo was married, but separated and had a fiancée.

Fighting back tears, Ngcobo's mother Sokhembone Ngcobo testified in aggravation of sentence on Monday.

She and her husband drew government pensions which were inadequate and she worked three days a week to try to make ends meet, she told the court.

Sentence will be passed on Tuesday morning.
