Killer dad applies for bail

Johannesburg - The State on Friday abandoned a bid to have the bail application of a man, who allegedly killed his daughter's boyfriend and father, postponed in the Benoni Magistrate's Court.

Retief Liebenberg of Benoni, Johannesburg, was arrested last Thursday in connection with the shooting of his daughter Chevonne's boyfriend, 19-year-old Dewalt "Poena" Visser and the boy's father Dewalt Visser, 46, in his home.

Liebenberg is facing two counts of murder.

Prosecutor Thabiso Mosikili earlier indicated that the State had not obtained a statement from Chevonne Liebenberg.

He said she was not well and in a bad emotional state.

Her statement would enable the State to change the offence from a schedule five to a schedule six one, Mosikili said.

In terms of schedule six of the Criminal Procedure Act, an accused can only get bail if he or she proves that exceptional circumstances exist for it to be granted.

Schedule five and six offences include murder, rape, and robbery.

Marius van Wyngaardt, for Liebenberg, said the State had had enough time since the last appearance on Monday to obtain the statement.

The defence was only aware of the offence being under schedule five and not six, he said.

"The State have enough documentation from witnesses. I oppose further postponement and ask that we proceed with the application."

Van Wyngaardt said he would not oppose the State's bid to change the crime to a schedule six offence.

Mosikili then abandoned his bid for a postponement.

Magistrate Ian Cox allowed the hearing to continue.
