Legal firms to write free wills for one week

PIETERMARITZBURG attorneys will draft free basic wills during National Wills Week from September 14 to 18.

The Law Society of South Africa (LSSA) said it was important to have a valid will drafted by a professional.

A will allows people to state their last wishes, who should inherit their assets and property, to appoint an executor of their choice for their estate, and also a guardian for minor children.

“If you were married, divorced or widowed recently, or you have started cohabitating with your partner or have bought new property, you must have a will,” said the society’s co-chairpersons Busani Mabunda and Richard Scott.

Similarly, unmarried persons — particularly those who may have a number of people and extended family depending on them financially — should ensure they have a will in place, as several people could make a claim on their estates.

If a person dies without leaving a valid will, their assets will be distributed according to the provisions of the Intestate Succession Act.

These provisions ensure that possessions are transferred to spouses and children, and, where applicable, to siblings and parents.

However, these may not be given to the people of the dead person’s choice.

In order for your will to be drafted, you will need to take these to the attorney:

•Your ID document.

•An asset list and the approximate value (including specific personal items that you wish to bequeath to specific people).

•Who must get what?

•Who should be the legal guardian of your minor children (those under 18)?

•Who should be the executor of your will?
