MPs list complaints against Madonsela

Cape Town - MPs refined a list of allegations against Public Protector Thuli Madonsela on Tuesday, which she must answer to next week.

Parliament's justice portfolio committee met to discuss how it would deal with numerous complaints, many made anonymously, of maladministration in Madonsela's office by staff.

Madonsela, who is set to appear before the committee on 2 August, will also have to answer to allegations made by her former deputy Mamiki Shai.

Committee chairperson Luwellyn Landers said there were several allegations to which Madonsela would have to respond, including:

- Non-compliance with policy with regard to overseas travel and transfer of staff;

- No clear demarcation of roles between the deputy public protector and the CEO;

- Inadequate allocation of resources to the deputy public protector;

- Questionable internal controls; and

- Fruitless expenditure.

A letter containing these and other complaints would be sent to Madonsela so she could adequately prepare a response.

More allegations

Some MPs have added to the list, including DA MP Debbie Schafer.

She said: "I was particularly concerned about allegations regarding the appointment of... Mthethwa. There were allegations that Mthethwa was previously suspended from Salga [the SA Local Government Association] and that he didn't disclose this."

Schafer was referring to Madonsela's CEO Themba Mthethwa, who is currently under police investigation.

Madonsela has been accused of protecting him.

In November, Shai told the committee that in the course of her work in the public protector's office, her signature had been forged by Mthethwa and that the matter had been reported to the police.

Landers said Madonsela would not be asked to respond to this particular allegation, as the matter was currently in the hands of the police and the prosecuting authorities.

While some MPs believed the auditor general and other institutions should be asked to investigate, most felt the committee should be allowed to hear from Madonsela, compile a report, and make recommendations to the National Assembly.

The House could then decide to pass a resolution and ask the relevant authorities to investigate, where necessary.

Staff grievances

MPs agreed many of the allegations would be difficult to investigate, as they had been made anonymously.

"If you receive allegations from members of the public and staff members who wish to remain anonymous and we refer such an allegation to the public protector, she'll turn around and say: 'When did this happen? Where did this happen? Who is this person? I have the right to interrogate this person's allegations.' And then the whole thing just flounders, and she'll be perfectly in her rights to do so," Landers said.

Landers said that while the committee could make recommendations, it was not a tribunal with investigative powers.

MPs would try to establish whether there were internal mechanisms within the protector's office to deal with staff grievances.

If not, this would have to be dealt with, he said.

Interesting how people are quick to jump to conspiracy without discussing the merits of the complaints against Thuli. If she is expected to be the nation's moral compass why is she not being open about goings on in her office? And why hiring and protecting someone under police investigation? Always when questions of her credibility comes to questions she will look for a big case to feed the media and distract attention from her.

    There's a lot worse happening in other sections of government and no-one has to answer to those - ie Nkandla, Guptagate, and many more. Why is the president not held accountable for Nkandla?

    The reports that the Public Protector must time and again be howled before parliament is annoying. In fact the politicians want her not to investigate them and be silent on their wrong doing. Madonsela keep doing your job. I think the creation of the public protector office was not mistake, and the person in office is unlike those before her doing a good job

      I presume you mean "hauled", not "howled". But then again, when you see how MPs from the majority party behave, perhaps howled is the right word after all. But you are right, Rantshu, without the Public Protector and the Auditor General, things would be even worse in terms of waste, theft and general corruption in all three levels of govt - perish the thought.

    U can never take down the relentless woman. She is one of the most diligent public servant worker and takes no nonsense from the ANC. Just because the arms deal is under investigation, then all these allegations pop up. U right, they remain annonymous coz these people were created by the affected politicians. We are behind your Ms Madonsela, root out these corrupt politicians.

    This Dept and this lady will never be successful. If you believe the ANC would allow her to operate without interference from them, this would be a first. They are the ones that are stirring up the trouble and making Thuli's job difficult at every turn. I also believe that we will never get the honest truth anyhow, as she has to submit her findings to them, then they obviously filter the evidence, so that in the end, its merely a slap on the wrist. If she should go against any of them, they will take her and her family out, as thats the way they work when they feel threatened. Thuli's job in real truth is to find the evidence so that they can filter it down. Why have we not seen cadres prosecuted, or fired for their misdeeds, its a waste of time and taxpayers money because its a farce. The ANC let the people believe that this dept is doing a good job by investigation any wrong doings....ha ha ha that they would allow her to name and shame....
