Madonsela: Western Cape contract valid

2012-06-01 13:07

Pretoria - A contract between the Western Cape government and advertising agency TBWA was not invalid, Public Protector Thuli Madonsela said on Friday.

She told reporters in Pretoria she had made four findings of maladministration, but found no evidence of unlawfulness.

"I haven't made a finding of unlawfulness," said Madonsela.

Proof is in the pudding !!

      procold2 - 2012-06-01 13:32

and a waste of the pp's time, at least its cleared up now she can continue the other high profile corruption charges in the anc, good work

      Tsotsi-Baby - 2012-06-01 13:37

      You actually believed it?

      Tony Lapson - 2012-06-01 13:45

What's your reason for not believing it?

      colin.dovey - 2012-06-01 13:46

Egg on your face @Tsotsi - pity is not that the ANC cannot say the same about it's morals and honesty. Unless of course YOU are slyly suggesting the Public Protector is suspect? - Wow!

      Tax - 2012-06-01 13:53

Hey Tsotsi my maid is looking for you she says you owe her child support...

      Jack - 2012-06-01 14:09

We would like to thank the public protector for taking the time out from investigating the R25+ Billion corruption of the other 8 provinces to tell us that the Western Cape is a finely tuned governing machine. I know it's a bit desperate when you have to look in every nook and cranny to find some dirt.

      Jono - 2012-06-01 14:10

@Toti...what is your problem dude? u dont trust white folk and now it looks like you dont trust black folk either?

Groot trek back to Wester Cape

      Tsotsi-Baby - 2012-06-01 14:30

First it was invalid now it is valid? Madonsela has let down the people #Power to the people

      Sganja - 2012-06-01 14:32

Yes Tsotsi,I think she must step down when her term expire...

      christian.denyschen - 2012-06-01 14:52

      John - 2012-06-01 16:36

I don't want to re-write your description of maladministration but you seem to have the wrong word I think you described the A.N.C

  • Sharon - 2012-06-01 13:12

There we go big mouth ANC, there was no corruption. The findings related to procedural errors. A wonderful validation to Helen and the DA.

  • Themba - 2012-06-01 13:12

    What maladministration?

      vermeulenwa - 2012-06-01 13:34

Maladministration is a political term which describes the actions of a government body which can be seen as causing an injustice. The law in the United Kingdom says Ombudsman must investigate ‘maladministration’. The definition of maladministration is wide and can include: Delay Incorrect action or failure to take any action Failure to follow procedures or the law Failure to provide information Inadequate record-keeping Failure to investigate Failure to reply Misleading or inaccurate statements Inadequate liaison Inadequate consultation Broken promises Source: P.S. Sorry for sounding like a wise-ass...but you did ask :-)

      Jason - 2012-06-01 13:46

Uhmmm no, Themba asked 'What maladministration' NOT 'What's maladministration' - big difference.

      John - 2012-06-01 14:01

      Bigger wise-ass!! LOL!! ;)

      mario.dippenaar - 2012-06-01 14:16

Well, I found his explanation quite informative.

      John - 2012-06-01 14:20

      Boils down to negligence.

      John - 2012-06-01 14:27

Why the thumbs down? Vermeulenwa posted the explanation. Sums up to negligence does it not?) - 2012-06-01 14:51

Vermeulenwa, The cases of maladministration were that they wasted 8000 rand by putting the advertisement out twice, they forgot to take minutes in a couple of meetings and it wasn't really appropriate for political appointees to be on the panel. Small stuff in the scheme of things.

  • julian.booyens - 2012-06-01 13:13

ANC trying to point fingers and nothing unlawfull was found, a slight case of foot in mouth disease hey

      Andres - 2012-06-01 16:56

Pity it falls on deaf ears, as can be seen in Sganja and Tsotsi's comments above: If the DA is vindicated, the person vindicating them is an apologist or lapdog, if the ANC is vindicated, they're transformist and democratic. You can never get the blindly loyal to admit they were wrong. They will always believe ANC-propaganda over everything else. To say otherwise is counter-revolutionary, Apartheid-apologist or imperialist.

  • Mark - 2012-06-01 13:14

Ho, ho, ho. Could she possibly state the same about ANY other provincial government?

  • Loo - 2012-06-01 13:14

So that you can draw my penis? To call our children refugees? #Power to the people - 2012-06-01 14:37

@Totsi - Surely everybody should be allowed to do what the law allows us to do? Or do you define freedom as freedom to do what you agree to? As for the Spear - Well the ANC was heading for a hiding in court. It had no chance. So it resorted to bullying As for the 'refugee'comment - Zille referred to the people as 'education refugees' & not just refugees. I have an overseas friend of mine that is a 'tax refugee' . He cant spend to long in certain countries because he will be sucked into their tax system. He calls himself that and is not offended. I wiah I was a 'tax refugee' because it would imply wealth well in excess of what I have. As for the term 'education refugee' well people may have taken offence but it is in no way offensive. If a parent moves his family from one province to another to give their children better opportunities then I admire those people. Its a sacrifice to leave ones home and friends. Good for them for making the sacrfice. What should be criminal is that some felt the need to make such a sacrifice. If Limpopo, Polokawane and the Eastern Cape were doing a better job their would be fewer 'education refugees'

And the grand total of the financial implications should the report have been found to be invalid - a whopping R8000. Yes, corruption is corruption and should never be tolerated in any form, but really, if this is the best the opposition in the WC can come up compared to the 100's of millions missing in other provinces then they really are a very sad bunch..

      Sharon - 2012-06-01 13:35

LOL @ Kagiso. And that was the best you could come up with? Bullying and bribing is something the ANC is REALLY good at. Maybe you should lay it at their door!

No that is the ANC/Cosatu/SACP style as seen by the Spear saga.

      Dee - 2012-06-01 13:52

Kagiso - I can (sort of) understand the need (from both 'teams') to foolishly react like "Soccer Supporters" in our political arena. But from 1 human to another - please may I ask that you don't disrespect Thuli Madonsela. She is a rare national treasure - having repeatedly demonstrated her ability to be a 'referee' of the highest moral character.

      colin.dovey - 2012-06-01 13:53

Egg on your face as well @Kagiso - pity is not that the ANC cannot say the same about it's morals and honesty. You seem to be very familiar with the DARK world of death threats and golden handshakes....where do you ply your trade? Obviously not the DA or the it must be your ANC Cadres....:-)

      Kyle - 2012-06-01 14:35

ur so concerned with a small problem in the da, wishing it was bigger, yet you ignore the anc's blatant disregard for the law. Worst government in the world. Besides the rest of africa ofcourse.

  • John - 2012-06-01 14:03

Oh, crap!! This means they still only have the toilets-without-walls debacle! Back to the drawing board! ;)

      Stirrer - 2012-06-01 14:09

Actually, they don't even have that. The ANC provided many more open toilets than the DA, they got reported in droves (by ANC voters, nogal) when the original story broke.

      John - 2012-06-01 14:11

Humph! I missed that! It's so ludicrous it's funny!

      Jacqui - 2012-06-01 14:36

The ANC quickly buried their open toilet saga and the people still catch cold on the bladder from using the bush instead.

y the findings so early than expected

      Adriaan - 2012-06-01 14:21

Generally when someone keeps proper records the process is quick. However when people have something to hide like the ANC where PC's dissapear and paperwork goes missing it takes a while longer. Transparency lends itself to efficiency.

      Tony Lapson - 2012-06-01 16:05

It is the same story with auditing a financial year end in a business. It can take anywhere from a day, to a week depending on how many issues need to be investigated. As adriaan said, if you have to spend 3 hours tracing a single dodgy transaction it can take a painfully long time.

      Andrew - 2012-06-01 16:51

I could investigate R8000 in a day and I'm not an auditor. When it's billions, it takes a long time. Logic? Any?

  • Robin - 2012-06-01 14:20

Wasn't it Fransman who started this bull in the first place? Now that the D.A. is proved to be innocent - Fransman; are you prepared to step down - 'cause that is what you demanded from Zille !

      John - 2012-06-01 14:21

      Jacqui - 2012-06-01 14:38

Fransman has had every party there is in this country and since no one will ever give him anything more that the fool's role he is back with the ANC. They won't give him anything either, but hell he hasn't woken up to that fact yet. Idiot.

  • Mbavhalelo - 2012-06-01 14:22

What makes me very happy is dat a lot of black ppl are joining de DA and dat means very soon we will be having a black president for de DA we will see if white and coloureds will still vote 4 de DA when its national spokes person Mr Maimane becomes its president. I also want 2 join de DA and make myself available for leadership. Amandla

      Carla - 2012-06-01 14:28

Provided their aims stay the same, it doesn't really matter who is in charge of the DA

      Rob - 2012-06-01 15:02

Mbayhalelo: I don't care which party has a majority, just as long as the majority is very very small. That way governement administers .....and it does not rule!

      Tony Lapson - 2012-06-01 15:37

It has never been about race anyway. Many coloureds (myself included) and white people just want to see a well managed country. Human is human.

      Vic - 2012-06-01 15:56

Please Mbavhalelo,to make yourself available for leadership in the DA, you will have to start at rock bottom, and undergo the " tea girl " test, which you are bound to fail! Have to have intelligence. By the way, if the DA appointed a black president, you can be sure it would be a very competent one, unlike the present, and I would be happy with that.See, I'm not a racist, but just want good governance.

      Andrew - 2012-06-01 16:48

I personally would love a black DA president. DA and the ACDP are the only multi racial parties in this country.

      theprodigy.brian - 2012-06-01 17:17

sure, I am not racist so I have absolutely no problem supporting a black leader in the DA or even in the ANC for that matter, just as long as they run the country properly & uphold the constitution. Im happy that black people are starting to embrace the DA, because we need another plan, the ANC one is broken.

      Mbavhalelo - 2012-06-01 17:39

Friends Maimane seem good 2 me and after all I will get voted not employed it is democracy remember. I just dont want coconuts running de show. And I honestly want de black race 2 rule for many many years I am jst disgusted with corruption @ this stage. Black people are capable only if de likes of blade Nzimande and de Zuma camp leave de ANC and competant ppl take over I will be happy, but fellow South Africans ur comments are good. Let de DA hv too many blacks and lets see how things unfold. Black ppl must @ least have 200 years in power den after dat de question of equality in South African races will hv been adressed

  • Jacqui - 2012-06-01 14:23

We knew that before she said anything.

  • mpho.c.moreki - 2012-06-01 14:37

Since DA has come out clean in almost all investigations against them,I think they should be given a chance to run this country.

      Mbavhalelo - 2012-06-01 17:23

Put Maimane as head of de DA and lots and lots of black people @ de highest ranks of de DA and u hv my vote right away

      bertie.brink - 2012-06-01 17:43

@mbavhalelo Why does skin tone bother you people so much? DA does a good job at running the western cape why not the country. why must things always be BEE before someone will do something or vote? your statement is semi racist saying put lots and lots of black people b4 voting.... why??? if someone is good at their jobs let them do their work to benefit us all.

      Mbavhalelo - 2012-06-01 21:16

The black africans must govern this land and it is just a setback 2 hv a lot of de damaged once in de rulling party. U urself knw dat der are many good things dat de ANC gvt did. I hv an RDP house as we speak and dat is a great relief and I do not think a white president would push land reforms agenda as well as BEE etc. Those things u would not like bcos it is not important for u but it is for me and de black race. It is racism 2 u bcos u are not @ de receiving end of poverty. Many of my friends work at firms were a none educated white fellows get lucrative positions bcos de owners are white i will not vote de DA until der is lots and lots of black leaders who are compitant not coconuts like Lindiwe Mazibuko who knw nothing abt a black man's struggle. And those fools who were burning de state flag should be arrested.

I guess a complaint was lodged with the PP about the awarding of this tender by the Western Cape government. I assume that because there are so few complaints against the government of the Western Cape the PP took it up herself not necessarily to the DA in a bad light but because she passionately believes in clean government and right now the DA is the only political alternative to the ANC which appears to be riddled with corruption.

to start off with, da must first close all open toilets, everytime one talks about western cape, it stinks

      Tax - 2012-06-01 16:01

They did enclose them but the Middle Aged Criminals League tore them down. Remember?

      Andrew - 2012-06-01 16:41

It's amazing that ANC supporters have two things to say about the DA when complaining. R8000 spent and open toilets. Both are false allegations and proven. Should DA supports list the ANC's faults? You may need a few weeks to read them. Shame blind kids of the ANC cult, robbing you till your death. Voting ANC is like begging someone to hit you with a bat.
