Malema to oppose bankruptcy application

Johannesburg - Expelled ANC Youth League president leader Julius Malema will oppose an SA Revenue Services (Sars) application for his sequestration, his lawyer said on Friday.

"I can confirm that we have been instructed to oppose the application," said Nicqui Galaktiou.

According to papers filed in the South Gauteng High Court in Pretoria this week, Malema owes Sars R16m and is "factually insolvent and in no position to make payment of his indebtedness to Sars".

Sars reportedly said in the paper that discrepancies in Malema's representation of his net assets were not conducive to concluding that he had made a full and frank disclosure, and supported its contention that "it would be to the benefit of Malema's creditors to sequestrate his estate".

If the application succeeded, all Malema's properties - including his house in Sandton, and his house, smallholding and farm in Limpopo - would be placed under curatorship and auctioned to cover his debts.

The hearing is scheduled for February 27.

    Shame the man is definitely a born fool. He should pay SARS with the sale of his flashy vehicles, designer clothes, lavish residences, etc. and move on. Yes he might feel like a leper but he must start his own party soon[not that I will vote for him at anytime]that way he can assist in weakening the ANC power come next elections. Waiting at the door of the ANC is stupid cause for him it will never open. Give the man his due though, he is an excellent orator and people with that ability should be contained. Hitler too was an excellent orator and look at what he did to the Jews.

      Ah, the problem come in, where in fact, all the cars and houses are bonded/owned by a finance house - so selling them, will not raise capital for Juju, merely pay off a debt. The receiver has found that juju's liabilities (debt) exceeds his assets, and thus, Juju has WAY bigger problems than trying to sell off a car or two.

      Yes Malema made mistakes big time, Trust me I am not a fan of this guy. I just argue that as much as he deserves to be tried, so do our President and many others in the ANC. But because that is not happening it is definitely sending out mixed messages.

      Taryn, I totally agree but I doubt we will ever see the day he is placed behind bars. Problem is he knows too much dirt to the rest of the government for then to risk putting him away.     after his legal fees to fight SARS he might just as well concede now that he has less friend willing to give up their wealth to bail him out as there will be no return for their efforts. You have many friends when they can get something out of dealing with you - his role is no longer one that can make things happen - so its will get ever more difficult for him to throw money after his pursuers with farming income from cash crops
