Man held for drinking killed in cell

2012-07-25 09:10

Cape Town - A man who had been locked up in a holding cell after he was caught drinking in public, was killed by two men during a fight in their cell in the night, a court has heard.

The Cape Argus reported that Daniel Dyosi, 40, and Sipho Mhlanga, 33, had been locked up at the Durbanville police station for drinking in public on 21 April.

When airport freight clerk Eben Meyer was brought to their cell a few hours later, he allegedly started attacking them.

“When I woke up, (Meyer) started assaulting me,” Mhlanga testified.

“[Meyer] said a number of things, like we are kaffirs and not allowed to sleep there. We allowed him to assault us for 30 minutes and then we became tired and fought back.

“After we assaulted [him], [Meyer] apologised and [Dyosi] gave him a blanket and then we slept.”

But at about 04:00, police discovered that Meyer had died.

The State said it was in possession of witness statements that told how Meyer’s head was bashed against the wall and on the concrete floor during the fight.

Dyosi and Mhlanga were charged with murder.

Both men have requested to be released on bail to look after their children and find new jobs.

      martin.ferguson.7311 - 2012-07-25 09:59

The authorities probably stood by and watched it.There is so much more of this but its coverd up.I was locked up infront of my kids just for asking two SAP Members why they were visiting my nabour while they should be on duty???

  • JHLR73 - 2012-07-25 09:33

Wow,now sure, we stongly believe the statement made by the two murderers!!Yes, they could not call for help when they were assaulted by the white man, so in return they murdered him. Wow, we strongly believe you, you murdering scum..And why did the police not hear anything?? Cry the beloved country of South Africa, long and uphill battle awaiting its citizens..

I'm black and even I don't believe that...Injustice cause more crimes..Black eye on your police and justice system...Don't care about their color..I care about their ethics..Then asked to go be with their families..Should be an insult to the world...Wake up South Africa Justice system..

  • declan.kelly.54 - 2012-07-25 09:39

So this guy gets locked up, starts swearing at and beating 2 thugs (which they let him do for 30 minutes), then the 2 guys politely beat him in retaliation and gave him a blanket. Maybe he fell out of bed during the night, crushing his skull. Sounds true to me. He obviously deserved it...

@Jackie.stone.501 It is not to say that he used that word as it is the two men whom assaulted and killed him's word against a man whom will never speak again whom should have been in the care of the state and they let us as society down again by letting another person die in their care. This has happened so many times and you only hear some of it not all the cases. And then why is the officers on duty also not charged, they should be checking in on the prisoners at least once an hour(according to the rule book). I am disgusted by what is going on in OUR country, you should go out to the out lying towns Strand, Paarl ect. and go and sit in on hearings in the magistrate courts and then you will know that there is a hell of a lot going on you never hear.

  • riotousr - 2012-07-25 10:02

Both sides of the story. The other dude is dead. There is not going to be any side from the story. The police where in John Vorster Square. Actually, I more than suspect that the victim fell when he stepped on a bar of soap. Or maybe he accidentally hit his head against the urinal when he was puking. Either way, let us leave this matter to our ever so efficient justice system.

  • paco.rodriguez.9210 - 2012-07-25 10:04

that is what happens when you are racist

      dieter.muller.942145 - 2012-07-25 10:07

yes parco... so if i walk past a black dude during my lunch time and he calls me a boer ... i can kill him? idiot gemors

      alfred.neumann.142 - 2012-07-25 10:16

No Mr Muller. You can kill him for being black and then just tell the police that he called you a boer afterwards. It's called the racecard-reversal-and-I'm-the-victim manoeuvre.

      jacob.siyanda - 2012-07-25 10:44

I’m sorry for being ignorant, but is it a bad thing to say “Boer”??? Shucks! I better be careful next time I buy some Boerworse…………… I mean Farm-Sausages

      felix.feline.3 - 2012-07-25 11:00

Lol Jacob, reminds me of when they changed the name of N-balls to black balls at school. I had not even made the connection until they banned the name.

      christopher.pool - 2012-07-25 14:09

You, Paco potchie, are a chop.

  • ndyeboreginaldmazawule - 2012-07-25 10:19

So the cells have no guards at night, a man just got killed for serving weeks in jail. They should Selebi and Shaik in those cells

The police officers on duty when this happened are just as guilty, and should also be charged with murder.

  • dela.rey.5458 - 2012-07-25 11:50

this and boy 12 drowned in hot water makes my blood boil, HELL is waiting for these animalistic f*cks

  • Lennon Chenga - 2012-07-25 11:57

It's hard to believe that a guy would have the guts to insult two guys in a cell!! And beating him up until he died??? Words fail me.... RIP

  • jean.rossouwsa - 2012-07-25 12:07

BULLLLLLLLLLLLLL!!! how stupid do these people think we are to believe this! Waste of time to report this! 1 person attacking 2 without ant reason and then he dies after "reportedly" (and very conveniently a racist attack)called us names. And him being dead is now very convenient! Isn't it!! Can't defend himself!

  • eric.sopeni - 2012-07-25 12:49

Well I can confirm one thing, this is not 1st time this has happened a couple of years back my wife's nephew was also held in a cell in the Harare police station in Khayelitsha for exactly the same reason and was killed, the case was thrown out of court for no concrete reason, so all of this does not surprise me.All we(South Africans) have to do is stand up together no matter what colour we are and fight against these sort of things, because listen no matter what colour you are this ish affects you too.

      timmy.ditsele - 2012-07-25 13:50

Like I always say lets organise a million man mardch to pretoria Uniion building,no black white indian or coloured men, only law-abiding, tax-paying, hard-working citizens of this beautiful country of ours before its too late.PS absolutely no politicians.

  • bashin.monyela - 2012-07-25 13:49

So after killing a man, you want to be released? Ok I see.

  • darron.nagel - 2012-07-25 13:59

Second time this year in Durbanville this has happened !!!

      christopher.pool - 2012-07-25 14:12

Durbanville cops are the MOST INCOMPETENT BUNCH OF TWATS in the SAPS. They are incapable of doing any police work other than filing vehicle accident reports which is stretching their abilities. I won't even have documents stamped there.

  • bmaestro - 2012-07-25 14:00

no bail no new jobs.prison for life murderes

  • Raai.wie - 2012-07-25 14:10

He was caught walking under the influence, thereby putting other innocent people's lives at risk. I don't agree to the way he received the punishment, but he deserved to be taken off the road forever and these two guys finalized the sentence. Now they must also pay up for their deeds. Maybe the warning will be clear not to use the road as drunk pedestrians - 2012-07-25 17:16

  • John - 2012-07-25 14:42

Good old SAPS. Surely when you lock a psychotic rapist, a murderer, an armed robber, a thief and a public drinker in the same cell who are ALL innocent until proven guilty YOU, the SAPS have a contratual obligation to keep all safe until you bring them before a magistrate. Let us face it people, WE need to straighten out our SERVANT the SAPS.

  • gail.j.neegraham - 2012-07-25 16:08

Both the murderers and the all the people in charge of the cells including the the arresting officers, have signed their own death sentences. God will not let this go unpunished.......

      hsebolelo - 2012-07-26 08:06

N dat god Of urs allowed dis meyer to b\r\n Killed...

  • chris.booise - 2012-07-25 16:22

Why would 2 men allow one person to assault them for 30 minutes. It doesn't make sense. And it's so easy now for them to say that they were called the k word. Do they think this is going to give them a lighter sentence?

  • annemariebotha.lanigan - 2012-07-25 21:20

The video footage of the man taken outside the bar, shows him to be unable to even stand. Yet he was able just an hour or so later to have sobered enough to be able to not only stand, but to attack two people for thirty minutes. I think the defendants story is absolute tosh. May they rot for it!!

  • sonstrale - 2013-06-03 10:33

This is shocking. The police officers on duty should be disciplined for not doing their jobs properly.Things would have been different if the good ones were on duty.No lessons are learned because this seems to become a regular thing.
