Money was for Zuma's kids - Shaik

Johannesburg - The millions of rands convicted fraudster Schabir Shaik gave President Jacob Zuma was for the "upkeep and education" of his children, the Mail&Guardian reported on Friday.

Shaik told the newspaper he gave the money to help the children with "no pressure whatsoever from the president".

The funding was "so that he [Zuma] would not have this financial burden. So that he could focus on the issues at hand," Shaik was quoted as saying.

Shaik was found guilty of two counts of corruption and one of fraud in 2005 for alleged irregular financial dealings with Zuma, who was deputy president at the time.

In January, The Sunday Independent reported that Shaik wanted a presidential pardon and the repayment of R2m he claimed was outstanding on loans to Zuma.

According to the newspaper, an amount of R2.5m had been loaned to Zuma, and was primarily used for his children's upkeep and educational needs. Only R500 000 had reportedly been repaid.

The Mail&Guardian reported that Shaik had denied benefiting from his relationship with Zuma, and had said he had unsuccessfully tendered for several projects in KwaZulu-Natal while Zuma was the MEC for economic development.

      Its called personal income tax, you know, that thing we all pay monthly on any income received, be it for work, or personal gains.. SARS by law requires you to declare everything you receive.

      Wow...I am learning something new right here. I guess have been guilty of tax "evasion"/non-payment given that I have: - Borrowed money to buy a car - Borrowed money to buy fixed property - Borrowed money using my property ("access bond" or drawn down on my equity) - I borrow money daily from my bank or "credit card" - I borrow "money" everyday when I trade only just paying a margin with the rest borrowed ...the list goes on.... Not once have I paid income-tax on any of the above. So, how does SARS suppose is the service I provided to earn this "income" from which SARS expect income-tax?

      lol napolita.kio When you took out a bond, you paid tax.. when you borrowwed money from the banks, you got taxed... You cant be taxed seperately for that as income tax. When it comes to receiving money from someone that as not registered as a credit provider (adding tax to the loan), you are responsible for declaring those funds received, and be taxed on it..

      @TheTruth I so much love how you conveniently leave out the most important word(s) that prompted my very first question to you. Pardon my repeating myself, WHICH tax would that be? You answered saying "income tax". My second reply was to point out to you of the transaction that I perform, some almost every day, for which I do not pay INCOME-TAX! Certainly when applying for bond there are FEES and finance charges to the financial institution and also (I think) values-added-tax(VAT). I, meaning, Me, myself, have NEVER paid INCOME-TAX on any transaction listed above. I am and was not being sarcastic when I listed those transactions. I am telling the TRUTH Mr TheTruth. You are factually WRONG to say the tax that one pays when borrowing money is INCOME-TAX. When you swipe your credit card, a euphemism for LOAN, you are in fact using borrowed money and there is no tax paid, or at least I do not. I TRADE financial securities every single day using margin account and I do NOT and have NEVER paid any tax! I understand the feelings people have to "bash" Schabir[sic] but it would be enlightening if people did so with facts. Doing that way would add credibility to the "bashing" or criticism.

      @ napolita.kio Also to add, I'm not a professional accountant.. i might be wrong.. Thats just my experience with sars and having to declare income received that was not from an official bank. As far as i know one can receive gifts up to 100k per year tax free. there after a flat rate of 20% applies. Seeing as shaik is not a registered credit provider the "loan" is invalid by default.

      @TheTruth, Neither am I an accountant. See, the exchanges between you and I would have ended sooner should you have responded "appropriately" to my first question and probably second. In short, there are various taxes with various names: VAT, excise tax, income tax, STC, STT, CGT....probably 20 of them. My question sought to find out which of these 20+ taxes applied. And you responded with an incorrect answer. Needless to say Schabir says he "GAVE" and not "LOANED". Whether Schabir is lying (as regards, load vs gift) is another matter, however, knowing the TRUTH (loan vs gift) would determine the kind of tax to be paid and by whom. And that tax is NOT income tax! I hedge my bet by saying, I COULD be wrong. And if I am wrong let FACTS prove me so.

      Ok napolita.kio , you might be right in saying that its not labled as income tax, and oppologies if i came accross harse. I'm the first to admit if I'm wrong.. From what i can read online, it looks like its called Provisional Tax. Thats now if the money was given without the intent of receiving it back (loan). Loans from a registered credit provider will be exempt from tax. wether the "loan" was given before or after the stricht credit rates came into place has an effect on that, i wouldnt know.

Actually, in my experience it's not just in News24. I see/experience it in moneyweb, marketwatch, huffingtonpost, (sometimes), etc. So I think it's a "human thing" ;) Enjoy your weekend.

    If the money was to be used for the education of his children (Which sounds very unlikly) then you, as his financial advisor, should he insisted that the funds be placed into some form of trust fund or seperate bank account created specialy for this purpose. It does not take a rocket scientist to work that one out. Once any money is paid directly into a persons bank acount, it automaticly becomes mixed with his other income (in terms of the law) and to them imply that the funds that were then paid were for his children does not hold any substance. You Shaik, as Zuma's Financial advisor, which you stated you werein court when you were convicted, should have known this.
