My work is foolproof, protector insists

2012-10-15 22:18

Pretoria - Public Protector Thuli Madonsela said on Monday she had been consistent and objective in her decisions, and would not mind having her work reviewed.

She told reporters in Pretoria she would not be swayed by allegations of bias and misconduct reportedly made by her deputy, Mamiki Shai.

"All I do is to investigate proper conduct in state affairs. If I do find improper conduct, I say so. I do so bearing in mind that I may be taken on review," she said.

"When I make decisions, I make sure that I’m consistent in terms of my previous decisions. I also make sure that the decisions are in line with facts in the report and the legal framework."

She was reacting to a Sunday Times report on claims, attributed to Shai, that she, among other things, changed the findings of a report into alleged maladministration in the Democratic Alliance-led Midvaal municipality, and deliberately withheld its release until after the May 2011 municipal elections.

The results of the Midvaal probe were announced in November 2011.

Madonsela said: "From where I am sitting, I have never made a decision which I cannot justify, or that can't be justified by the report itself.

"I challenge you as journalists to read the reports, especially the one on Midvaal, which has the most absurd of allegations."

Madonsela said she had delegated Shai to lead the investigations into the Midvaal complaint. The final report was presented to her only after the elections, she said.

"For one to say I sat on that report to ensure that the DA wins in Midvaal is really mischievous, but it must be tested.

"We work through a memo system in our offices, which indicates when a report was handed to me," she said.

"Reports are not thrown at you as you walk through the door. I think people should read the [Midvaal] report and then ask whoever is accusing me what was in that report, that I removed which makes the final report unjust."

She said she wanted the African National Congress in Midvaal to be part of the investigation into the allegations of her bias.

Madonsela inherited Shai as her deputy when she took over from the previous public protector Lawrence Mushwana.

Turning to her finding on the Western Cape government's contentious awarding of a R70m contract to advertising agency TBWA, Madonsela said she had made her decision based on facts.

"I’m a lawyer. I know that on review the jurisprudence, at this stage, says a court of law will reject my findings if it believes a reasonable public protector, faced with the same facts and laws, would not have arrived at the same conclusion," she said.

"Having looked at senior counsel and representations before me, I re-visited the legal finding. All that they [the Western Cape government] had violated was a Treasury guide."

The unlawful action was not like rigging a tender or inflating a price.

"The unlawful part there was a disputed matter, that the premier’s adviser was included in a committee."

Madonsela said there were inconsistencies within the Treasury guide.

"I made what I still believe was the most reasonable finding I could make in the circumstances. If anyone thought I was wrong the best thing was to take me on review."

If she was a man I would have given her a Bells.

      wesley.bischoff - 2012-10-15 23:04

Lol can women not drink Bells? She deserves a whole case

      christopher.shining - 2012-10-15 23:59

If I was not married I would court her....

      christopher.shining - 2012-10-16 00:03

Not even bells man...A CASE of Johnnie Walker Blue...Any rich people out there...she deserves it.Then again she must stay partial, and if you give her a case of Johnnies, it could work out to a bribe down the line. SO...Lets just sing her praises!!! Well done Thuli!

      christopher.shining - 2012-10-16 00:04

Exactly Wesley...what you on about Mike? chicks dig Bells as well..

      sanchez.sancho.7 - 2012-10-16 08:02

Thuli can kick Chuck Norris and Felix Baumgartner's behind anyday

      Oh.allemagtig - 2012-10-16 08:22

The 'Give the man a bells' advertisement is chauvinistic. If it is ever flighted again, watch what happens to the woman among the men rushing through the door. No "after you my dear!' there.

      rupesh.hari.7 - 2012-10-16 09:23

This woman is amazing. She has the same respect I have for whites who fought apartheid in those days. Nothing can be hard as going against those people who think you are on their side.

      lerato.mautlane - 2012-10-16 12:43

Is the a possibility that Thuli can get a 100% pay rise please someone??? i really don't mind my tax money paying her salary...!!!

      wesley.bischoff - 2012-10-16 13:28

I agree with Lerato She does her job, and she does it well. She deserves a pay rise, based on performance.

  • SharonE - 2012-10-15 22:40

Thuli is my hero. She is an inspiration to so many! Stand strong Thuli, you have a LOT of support.

      wesley.bischoff - 2012-10-15 23:06

I agree. A strong woman that is educated and uses her intellect to better this country. The total opposite of the majority of the ANC. If she ran for president, I would vote for her.

      lerato.mautlane - 2012-10-16 08:56

@Wesley - i also agree, i would vote for her anyday!!! We need more ppl like her in all sectors....especially education!

  • stefan.erasmus.756 - 2012-10-15 22:41

Good work. We need people like you in this country.

  • julie.j.vanrensburg - 2012-10-15 22:45

I saw this coming - Thuli is just TOO honest and outspoken and the ANC don't like their dirty washing being hung out for all to see, hence this campaign against her now in an effort to 'redeploy' her elsewhere andappoint someone in her place that will be more lenient towards the ANC - in fact, putting party before state would be the requirement... Thuli, we are ALL behind you. Keep up the good work, Girl!

  • phumudzo.mudzusi - 2012-10-15 22:46

    Goooo Thuli...behind you 100%

      lorain.maseko - 2012-10-16 08:02

Sadly i doubt she will last in this position, people like her dont, maybe she shouldstart her own party, I will rig votes for her if I had to.

      wesley.bischoff - 2012-10-16 13:13

If they try fire her, we stand together and DEMAND (not strike) that they leave her alone. She is part of only a handful of civil servants that are honest and honourable.

  • daleinn - 2012-10-15 22:54

can someone noiminate her for president?

  • kobie.nel1 - 2012-10-15 22:54

That woman is gaining more and more respect from me. Dammit man, we are realy REALY in need of more people like her in this country, but I fear she is in danger from the top. They will not like her one little bit. - 2012-10-15 23:42

i also don't think she will be around for much longer considering her ethicalness & fearless....but that's south africa for you,be ethical you die or get fired

      collins.ntelele - 2012-10-16 07:29

Dear Kobie, propose marriage to Thuli,it seems you'll make a perfect husband.

  • crracker.crackerr - 2012-10-15 23:00

It's an old tactic to put pressure on decision makers by making it appear that they are biased. So they are forced or compelled into making decisions on an almost scorecard basis. If Red gets 50 hits then green must also get 50 hits. A balancing act in other words to make it seem that the decision maker is objective. The truth is more important than scorecarding.

      dan.ledwaba.5 - 2012-10-16 00:41

I hope she sticks with the truth.

      lorain.maseko - 2012-10-16 08:05

Bheki Cele also tried to supress her by amking up all sorts of allegations and he fell flat.

  • archie.mooki - 2012-10-15 23:08

It will take a REAL MAN to fit into your shoes!!!!!!

  • Bafana Joseph - 2012-10-15 23:09

Thuli Madonsela but you cant investigate the Big Boss Of yours Showerman Jacob Zuma for our tax maney

      DuToitCoetzee - 2012-10-16 07:14

Bafana it is on the books, but she has so many to investigate that even cloning her will not help. Did you ever hear of one taking the sand away under a pillar till it drops? Maybe that is what she is doing because Zuma's pillar is not build on rocks.

  • Brendon Reniers - 2012-10-15 23:25

I don't think i've heard from anyone more suited for the presidency... nice to hear from someone in the hierarchy that believes in what she says! Keep cutting them down girl!

  • pamela.jacobs.509 - 2012-10-15 23:25

    Thuli Madonsela for president!

      Robin - 2012-10-16 07:08

Don't think like a small child Ntshobs. Over the years Madonsela has made it very clear that she serves the people and not herself. Take your youth league mentality back to Malema for a refund.

  • whatda.fuqbro - 2012-10-15 23:35

We really need people like Madonsela running this country.

  • piet.boerie - 2012-10-15 23:51

The way the ANC deals with issues like strikes and delivery protests and of course killing of candidates it will only be amatter of time before she eyes Zuma and Zuma then eyes his gun. Watch your back lady these okes shoot to kill when they dont like you. 34 Miners can tell you about that.

  • hitting.thefan - 2012-10-16 00:10

Now atleast she knows her deputy is a conniving B!@ch. She can run straight to Zuma and co. Schemers everywhere!

      dan.ledwaba.5 - 2012-10-16 00:45

Yes, she must make that liar a teagirl in Nigeria..faaaar away from here.

      njabulo.jama.5 - 2012-10-16 06:04

She inherited her, think she's feeling bitter that she wasn't promoted. So now she's tryna use any means necessary to get her dismissed for \being-bias\, now we know what protector will get afta ANC gets rid of Thuli. #Pray4Mzansi only God cn help us now

  • carl.debeer.33 - 2012-10-16 01:06

    Yes, so was Breytenbach....

  • maluta.hector - 2012-10-16 04:44

Politicians don't need the truth. Still remember Taweni Mahlangu, who said is right for politicians to lie?\r\nThey will silence Thuli, either by deploying her somewhere in Africa,or permanent silence by assassination. Lets protect her with our lives, for the truth.

  • grant.montgomery.5074 - 2012-10-16 05:03

"My work is fool proof" An odd headline from news24. Surely something like, "My reports will stand up to scrutiny" would be more apt.

      haroldrvjansen - 2012-10-16 07:05

@ Grant, I think the term 'foolproof'is very accurate and well thought through and exactly applicable in SA at the moment.

      Andrea - 2012-10-16 08:12

Maybe they meant to say "fool/Shai proof".

  • raymond.kok3 - 2012-10-16 05:47

i hope the so called decision makers of the corrupt anc read all this comments on news 24 ,i think when they appointed her they thought she is soft spoken we will manipulate her, but no she is the man she got ball as big as big Ben ,i my lady salute you you are my Hero ha la la and when all of this is done fire than snake ,that Judas.

      njabulo.jama.5 - 2012-10-16 05:59

She's da most visible public protector n is dng her job w/o fear or prejudice. She's got em worried @ Luthuli house cos of their looting tendencies, which she'll expose sooner or later

  • Tebogo Matlou - 2012-10-16 06:08

artificial intelligence is no match for stupidity correct, applaud to Thuli. integrity and code of ethics is a threat to the corrupt stupid's in our leading Govt. they are well aware of the consequences of the investigations among all of them no one will come out clear! reporters should read not mess with your findings!

  • njabulo.jama.5 - 2012-10-16 06:08

She's lucky she's black, otherwise whe'd be labelled as racist...hehehehe

      Mzondi Wakwa Maqina - 2012-10-16 06:32

If Zuma makes it in Mangaung, then Thuli is gone. Mark my words. What happened to Scorpions? ANC has a lot to hide and if someone keep scratching and digging in the right direction then that person is gone.

      luvo.luvos - 2012-10-16 07:40

There's nothing laughable about your butt-licking statement. Sad that our people have to stoop down to those levels just to please their white masters.

      njabulo.jama.5 - 2012-10-16 07:43

Laughable is what our country and politics has become. U can't possibly plot to overthrow someone who's doing what she's paid to do

      richard.hipkin - 2012-10-16 08:41

@Luvo, yaaawn, want some salt for those chips on your shoulders?

      wesley.bischoff - 2012-10-16 13:16

Luvo you are delusional. White people are not the masters. Stop living in the past... how can you expect to walk into a successful future whilst constantly looking back?

      tasmee.hylkema - 2012-10-21 15:56

luvo.luvos, i didn't know that being piased, non biased, fair and honest was only a white thing!

  • Tiaan Liebenberg - 2012-10-16 06:24

No one's perfect. But transparency, accountability, ethics, and moral fibre goes a long way. Well done to her

  • john.smit.121772 - 2012-10-16 06:37

It is crazy that a person like Madonsela, with such a high degree of integrity, must defend her character, whilst Zuma do not answer to any of his corrupt actions.

      richard.hipkin - 2012-10-16 08:42

  • - 2012-10-16 06:47

Racists are very happy about thuli, she is doing good work for them &their coconuts, she has been biased from the onset, she is DA

      DuToitCoetzee - 2012-10-16 07:29

No, the people is relieved that we still have people like this woman to protect and guide us. We get so bombarded with crime and corruption that we all flock to one of the only lights still shinning. The fact that she is intelligent with outstanding character and black must be a bitter pill for you to swallow. Surprise comrade? Don't be! there are more of them. If we can only get them all to stand up and we will have more saviors. I think what bother you the most is that she explain all so logical and in understandable terms, but that he still do not understand it. Please do not stereotype her intelligent behavior as a race/white behavior. This is a known behavior to people with integrity and brains,....but what will you know about THAT!

      Tiaan Liebenberg - 2012-10-16 07:57

You, my friend, are a racist from your inner-most being. Why can't you accept that a black person might aim to be righteous without prejudice?

      lorain.maseko - 2012-10-16 08:12

Yes racists are happy about Thuli's work but then again shes not making thse things up,some people tend to give racists something to be happy about,so they can say "told you so". Thuli's job is to uphold the truth regardless of who will be happy or sad about the ttruth and she does exactly that.

      Andrea - 2012-10-16 08:13

Now that's the sound a true coconut makes, comrade!

      richard.hipkin - 2012-10-16 08:42

I'd rather be known as a racist then a rapist...

      lerato.mautlane - 2012-10-16 09:06

I thought Thuli is ANC and appointed by the ANC - how does that make her DA??? is Stupidity for SALE any1???

      lerato.mautlane - 2012-10-16 09:28

Thuli's position is very CLEAR - She the Public Protector - not "The ANC Protector" COMRADE, we must stop fooling ourselves and think the current ANC has the people's best interest at heart...Thuli is really a breath of fresh air

      conrad.marshall - 2012-10-16 10:12
