One of gang rape accused goes free

Johannesburg - One of the men accused of raping a girl believed to be mentally impaired was released by the Roodepoort Magistrate's Court on Wednesday, their lawyer said.

Speaking outside the court, because proceedings were closed due to the appearance of minors, attorney William Karam told the media he had been released because of a lack of evidence.

Two others - an 18 and 19-year-old - were released on R1 500 bail.
The matter was postponed to September 6.

Seven people, including four minors, were arrested in Dobsonville, Soweto on April 17, after they were matched to descriptions of people seen in a cellphone video recording of a gang rape.

The video of the 17-year-old girl being raped went "viral" on the internet on April 18, and was one of the main topics trending on social networking site Twitter.

Two of the minors also implicated in the case appeared with the three adults.

A third minor was not present in court because he was writing his Grade 12 mid-term exams. His probation officer had confirmed this to the court, said Karam.

Two of the minors are 16-years-old. The third is 17.

A 13-year-old was appearing in a separate court room.

He was undergoing psychiatric evaluation to determine his criminal capacity.

Karam said the evaluation had commenced, but would take another month before it was concluded.

Not enough evidence??? Was the evidence not a video clip of the incident? This is when I welcome kangaroo court and communities to take the law into their own hands. Burn and murder the buggers!!! They are all cowards!

How in the fat f#ck is this possible ? You have video evidence ... *shakes head in disgust*

And you want to know why this still happens. I say if one of the accused that is out on bail commits a crime, they must keep the magistrate responsible

Mob justice must now take its course

  • ahenriquesfernandes - 2012-06-20 13:38

R1500? Wow that is nothing! I would be very VERY scared if I was one of the 2 that are out on bail. The public is outraged by this story and bad things can happen on the outside

I am trying to figure out how the application of the law and justice in this case is acting as a deterrent to anyone, including the seven accused, from doing exactly the same thing tomorrow. I suppose I will be told by the liberal lefties that eventually kindness and forgiveness will improve people's value systems. Maybe, but for every one person who becomes a model citizen I suspect that there will be 99 villains left.

  • nigel.burgess.52 - 2012-06-20 13:40

I know the Law must take its course, but hell, it really gets my blood boiling when a rapist gets bail. I hate the way these criminal Bas$%&ds get to enjoy such legal rights after they've taken away the rights of someone else and with such violence. It just doesn't sit well with me.

One of the most effective crime fighting mechanism we invented when justice was not serving us under apartheid laws was "Neclasing". Thanks to the neo-liberals who continue to undermine our ways of building a just society. That mechanism never saw a light of day in our constitution!

  • Cassandra Eileen Olivier - 2012-06-20 14:51

    Only in South Africa

  • roy.wadhams.1 - 2012-06-20 15:24

Hang the whole bloody lot irrespective of their ages. These people only work in gangs to show how "strong" they are and should face the full might of the law. Even at a very young age they know what they are doing.

  • roy.wadhams.1 - 2012-06-20 15:28

Useless government/ANC/Education/SAPS/Laws and everything else in this country where people no longer have rights to protect themselves. This country is F----d!
