Oscar Pistorius's affidavit highlights

In an affidavit, Oscar Pistorius made the following statement which was read out in the Pretoria Magistrate's Court on Tuesday by his lawyer.

I am an adult male, SA citizen and applicant in this application and seek to be released on bail.

I make this affadavit of my own free will and have not been influenced. Contents is true and correct.

I fail to understand how I could be charged with murder, let alone premeditated murder because I had no intention to kill my girlfriend.

I have been informed I have been acused of murder – I deny the accusation.

Nothing can be further from the truth that I planned the murder of my girlfriend.

I have no intention to relocate as I love my country.

I earn R5.6m a year. I’ve never been convicted of crimes.

I deny that I committed murder in the strongest point. Even though I don’t have to, I want to deal with these allegations.

Reeva had bought me a present for Valentine’s Day. We were deeply in love.

We were deeply in love and couldn’t be happier. I loved her and I know she felt the same way.

On 13 Feb Reeva would have gone out with her friends, me with mine. She wanted to stay at home.

By about 22h00 we were in my bedroom. I was watching TV. My legs were off. She was doing yoga. At the end of the evening we got into bed.

I’m accutely aware of people gaining entries to homes to commit crime, I’ve received death threats.

I sleep with my 9mm under my bed. I woke up to close the sliding door and heard a noise in the bathroom.

I was scared and didn’t switch on the light. I got my gun and moved towards the bathroom. I screamed at the intruder because I did not have my legs on I felt vulnerable. I fired shots through the bathroom door and told Reeva to call police.

I walked back to the bed and realised Reeva was not in bed. Its then it dawned on me it could be her in there.

I rushed back into the bedroom and opened the sliding door onto the balcony and screamed for help.

I put on my prosthetic legs, ran back to the bathroom and tried to kick open the toilet door.

I think I must have then turned on the lights.

I went back into my bedroom and grabbed my cricket bat to bash open the toilet door.

I called paramedics and complex security. I tried to carry her down stairs for help.

I tried to help her but she died in my arms. I am mortified.

With the benefit of hindsight I realise that Reeva went to the bathroom when I went to close the balcony door.

I trust the South African legal system and the facts will show that I did not murder Reeva.

I believe the forensic evidence will prove what I am saying. I used a cricket bat to break open toilet door.

I am an international sports star, I will not evade my trial.

After the shooting I did not flee the scene. I remained until the police arrived.

I dont know of any witnesses in this matter, and I won’t interfere with any witnesses.

My continued incarceration will be of “no benefit” to the state. Release would not disturb the public order.

      My question is why did he have a gun in the first place? Its not like Reeva wanted to kill him she loved him this is utter nonsense this was a pre planned murder there is any intruders I'am sure the Brazilian paralympic athlete isn't so petty why would he come back after a few months after the paralympics to kill Oscar why would he do that?       Who knows the circumstances... this is a tragic case and unless we were in his place, we have to rely on what he tells us. Sounds plausible. It may have been too dark at that precise moment when he went back for the gun.. remember he never had his legs on and would be that much shorter - not exactly in a prime position to see onto the bed!

      MiMi I do not know what happened. His statement as it is released above does not make sense with regards to whether or not he had his legs on or not and for me that needs to be clarified. I will not switch on a light if I suspect an intruder. I'm not sure how I will react in such a situation but during an armed robbery in which in which a man was shot dead three meters from me my instinct was to flee (fight or flight syndrome)and I did because I have both my legs. How dark is his bedroom? were curtains closed and is there any light source in his bedroom? Had his eyes adjusted to lack of light? Those things play a role in not noticing someone who should be lying down. Prhpas the bedding had been undone and in the dark could have registered as a figure. Remember he does not have the legs you and I have no matter how used to them he is, if they were not on he does not have the luxury of flight or protecting Reeva. Put in that situation I cannot tell you for sure I would act differently than he did. If I am unable to escape I will take out any threat before it gets close enough to hurt me or others I am trying to protect. Bloodied baseball bat: If he used it to break the door open (imagine realsing you've probably just shot your partner by mistake and imagine that panic) he could have dropped it in her blood resulting from the gunshots. If there is any blunt force trauma on Reeva then we know he is lying. I'm not defending him because I'm not sure I believe him.

      This is going to become very interesting when the State starts revealing the evidence. I would like to see Hougard,s SMS to Reeva, the forensic reports and the autopsy report. If her scull was really crushed, Oscar's entire defence will fall apart.

      When he went to take his gun under the bed, couldn't he at least wake Reeva up (since he assumed she was still in bed) and warn her that he suspected there were intruders in the bathroom and even hid her in the closet or under the bed before he ventured out to confront the intruders?

    If this is his affidavit then the stories being updated from within the court is not trustworthy? Nothing is mentioned about his earnings in his statement? I say give this man bail and let him receive psychological help to mourn and prepare for defending his case. Its sad that so many have found him guilty thus a bad picture has been painted and despite the outcome I know no one will forget this trial. From reports he seems broken in his spirit and 'if' it was premed then why so remorseful. Surely with his 5.4mil a year he could've 'planned' this plot better without handing himself over?

      I agree with you Natasha. If you plan to kill somebody you don't fire arbitrary shots through a closed door in the dark and hope for the best. The chances of actually inflicting a lethal wound in a volley of 4 shots through a closed door is really slim if you can't see what you are aiming at. If he really wanted to and planned to kill her he could have and would have done it without having a smoking gun in his hand, in his own home, surrounded by neighbours and witnesses. I truly believe therein lies the answer to the fact that it was not premeditated murder. This theory is also supported by the total remorse and devastation demonstrated by the man. My heart goes out to both families for this is a tragedy that is off the scale. May the truth be the only victor in this sad story.

      Nobody can put this better, he has paid dearly thus far by means of money , pain and remorse just to name a few. Why are people so judgemental when most facts from all the media houses that differ according to selective preference when reporting... His a brilliant athlete, a successful man and has proven to overcome his dissability from birth.       The problem of this article is that only snippets of the affidavit is listed. not the full affidavit, causing some people to make assumptions that was addressed in the affidavit. this is shocking half-reporting.

      I do agree with Toby, so many different stories has been told. What is True and what False???? Give him his chance, in due time we will hear both sides, evidence will be revealed and all will become clear. Now it's just one messy mud fight and journalists trying to get a scoop! Not that I'm coming up for Oscar, my opinion of him is that he has been and always will be arrogant and self loathing.

He is having a tough time with all of this and for someone who they say planned it should never be so emotional about it. It just proves he is feeling the pain of losing her - wake up people stop taking in every detail you read as the newspapers are making a mockery of this case and you are all stupid enough to believe every word they are saying!!! Spare some thought for his family as well they are going through just a tough time as Reeva's family.       Graham, this is News 24's shoddy reporting. I read the live twitter feed and he stated that he got out of bed to go and close the balcony door on his stumps. While on the balcony he heard noises and went back inside, got his gun from under the bed and then shot through the bathroom door. He claims that he called to Reeva to call the police and upon realising that she wasn't in bed he used a cricket bat to break the door. He never said he kicked the door down. Do people honestly think his defence team are so stupid that they would think anyone would believe he kicked the door down with his stumps? This article states at the top: "(This transcript is unverified and will be updated with the official version as soon as the court makes it available)"

      i am dumbfounded by the whole story...frm the way i understand it, he did not have a gun when he was closing the sliding doors. So when he heard the noise coming frm the bathroom i assume he went to fetch his gun that was supposedly under the bed. So why didnt he ask himself where his girlfrnd was or @ least call out her name to make sure if she was the one in the bathroom before shooting. this is simple logic.....i am disapointed by the Legal team and the Judge because he is given special treatment.

      Thank you my thoughts exactly. People are far to quick to make assumptions. Amazing that when we die they say it is God's will but when people do things like this God is never mentioned. He is in control of everything and he is the only that only knows what happened. Oscar only has to reply to him. God will see that the truth prevails and until then we need to give ALL families some peace.

    It seems it might be a better idea to give this case a month without reading any news, and then come back to only the facts. However, I guess that would mean locking yourself in a box and not talking to anyone. A lot of speculation, and very little fact. I'm even starting to get confused between 'news' and comments/opinions/speculations, as they all seem to be one at the moment.     The truth is evident ... I bet the story goes on a jealous shouting match, volatility, alcohol, possible "sweeties", insecurity, no doubt checking her phone for BB's or SMS's. A few slaps, pushes and next minute absolute explosion ..!! Lack of temper control, she ran, he chased with bat, she shut door, he cocked gun, insisted she open door and refused, he shot and kept shooting!!     Earlier reports state that Reeva was shot 1st in the hip in the bedroom imagine Oscar without legs? perfect height then 3 other shots are fired hitting heads length meaning he had to have put his legs on before the fatal shots were fired through the bathroom door that was locked while the 2 of them were alone at home!! Go figure!!

    ya, because when I break into a house to rob it the first thing I usually do is go into the bathroom! How unbelievable is this story! If I hear a noise in the bathroom in the middle of the night, the FIRST thing I think is my girlfriend is in there, not an intruder. How about saying, "Reeva, you in there?"....not AAHHHH!! DIE INTRUDER DIE!!! BANG< BANG< BANG. What a LIAR!!! Or the biggest moron in history. Either way, not fit to be part of society

    This just proves how badly this tragic situation has been covered. So many versions of what the affidavit states from journalists that were in the same courtroom. There will be holes in it too when compared with what should have happened, because guess what, if he did check where she was, she wouldn't have gotten shot. I believe this is very accruate to what actually happened. Remember, he's pleading not guilty to pre-meditated murder, not to not firing the gun. Imagine the emotional tourment he's facing, all the why didn't he do.. Questions he is asking himself. No wonder he's an emotional wreck.

    So he wakes up. Reeva is still in bed - this is not clear in affidavit - should've been stated. He goes outside and hears a noise, rushes back in to get his weapon ... in the pitch dark. He shouts at the intruder. Reeva in bathroom doesn't know what is happening as Oscar wasn't in bed when she got up. She decides keep dead quiet, lock the door. Oscar Panics and fear sets in. This intruder isn't replying (Reeva is keeping dead quiet) so something's up and he starts shooting. It does not seem so far fetched. Maybe everyone should give him a break and let justice go its course!

      We hear you adrian! Got a point there! But I agree with u till a certain pont! Yes he felt vulnerable, and that is why he shouted! The intruder being Reeva kept quiet! Fact is, there was no intruder, and why would Reeva keep quiet if she heard shouting! Surely she cudve peeped and shouted back! There are loop holes, things he's not saying that had happened! Coz right now, he's left us with question marks and assumptions.

    I make my comments based purely on my belief & principles and not to be seen as "taking sides". Having followed this story so intensely, i am tremendously dismayed at the attitude of people, media & so forth. I can understand the sympathy shown towards Reeva as i also sympathise with her griefing family & know the pain of having to lose loved ones. But what surprises me is the focus of the general public & educated people who have made such negative comments about oscar without even giving him the opportunity to explain the events that occurred that night. Why do people have to be so judgemental & be so quick to critise or is it that the public relies so heavly on the media that they allow themselves to get carried away. As for the media, they never seem to amaze me. I can only compare them to one phrase & that is " A WISE MAN IS MAN OF VERY FEW WORDS" so when i look at the length of a specific article, it makes me wonder far beyond my imagination but nevertheless i give them the benefit of the doubt. I am disappointed to note how vocal people have become in this matter. Almost as if Reeva has been the first woman to have been murdered or Oscar the first so called murderer in our country. So considering how vocal our people are i would like to suggest that everyone get together, gather every media & broadcast station & take to the streets a protest again crime, rape & murder but make sure it is being broadcasted to the world & never give up until u are heard.

    If he is so paranoid bout crime -and stresses so much about it and is so very afraid then why would he keep his balcony door open - hmmm I smell a rat - further if he did not have his prosthetics on how was this athlete moving around the room maybe he learnt from David blain and was levitating around - note he went to the balcony door to close it den he didn't have his legs on and fired shots n says he walked back to the bed-Oscar u got nothing to go by if anybody buys your story they are as daft and blind as you- imraan moolla

      2toby.strong.9. He claimed in the affidavit that the bathroom had no burglar proofing and that a ladder was outside from a maintance team, so whether you use ladder to climbed inside bathroom or over balcony same difference, no his stories is full of holes, not 4 bullet holes.
